In compliance with the court's decision, Ohio's Department of Youth Services (DYS) will set aside space within their facilities where youth in the centers can go to meet with an attorney when they have things to discuss regarding how they are being treated inside the centers. That attorney will then either deal with the issue him/herself or coordinate with outside counsel to find the young people legal representation.
The new hearings came about as a result of a lawsuit filed three years ago in which Jessica Penny, a youth in Ohio's juvenile system, filed a lawsuit after being sexually assaulted by one of the guards in the facility where she was incarcerated. Penny won the case, which was filed by the Children's Law Center in Covington, KY, and brought attention to the fact that many young people in Ohio's juvenile centers are turned down when they ask for access to the justice system.
Ohio's Youth Services denies this and has said that it is fully supportive of members of the youth centers having easier access to attorneys and the justice system.
"This is going to benefit the youth and DYS," Andrea Kruse, spokeswoman for the Department of Youth Services said in an Associated Press interview.
Kimberly Brooks Tandy, Founder of the Law Center, spoke to a reporter for the Dayton Daily News. In the interview, she said, "Access to the courts is probably the most important right that incarcerated people have because it allows them to access other rights. There has been a history of documented abuses and maltreatment of children in some of these (Ohio) facilities."
