Trump Appeals Order Requiring Testimony from Pence in Election Investigation

According to a source familiar with the matter, Former President Donald Trump has filed an appeal against a judge's order that requires his former vice president, Mike Pence, to testify in the special counsel's investigation into efforts to overturn the results of the 2020 presidential election. The ruling pertains to the Justice Department's investigation into efforts to undermine the election that Trump, a Republican, lost to Democrat Joe Biden. The case is currently under seal, but a new sealed case that references a grand jury matter has appeared on the federal appeals court docket in Washington, D.C. The court has set an initial schedule for the appeal, with final briefs due by May 25. Pence recently announced that he would not appeal a judge's ruling that requires him to testify to a federal grand jury about his conversations with Trump leading up to the deadly attack on the U.S. Capitol.

The judge's ruling in March stated that Pence could still refuse to answer questions related to the events of January 6th. Some of Trump's legal representatives have not yet responded to a comment request. Special Counsel Jack Smith, Attorney General Merrick Garland appointed in November to oversee two investigations involving Trump, is presenting evidence to grand juries. The first investigation is focused on potential attempts to interfere with the peaceful transfer of power following Trump's loss to Biden in November 2020. The second investigation examines whether Trump illegally retained classified documents at his Mar-a-Lago estate in Florida after leaving office in January 2021 and whether he obstructed the Justice Department's investigation.
