
According to the New Castle County Police Department, Simmons was released on Friday after he posted a $45,000 bail. He had been under investigation from March.
According to 6ABC, Simmons picked up the boy from his school and took him to Simmons' house. A teacher came to learn about the incident and informed the authorities.
Following Simmons' resignation, State Prosecutor Kathleen Jennings commented in a statement that, "The Department of Justice today secured Daniel Simmons' immediate resignation. We are deeply disturbed by the conduct alleged in this case. We are most concerned for the welfare of the victim. This case will be vigorously pursued to justice. Ethically we are prohibited from saying more."
According to USA Today, investigation by the authorities found that Simmons had met the boy through Grindr, a social media app, and not in connection to his work as a prosecutor.
The Delaware State Attorney General's office has been particularly sensitive about child sex abuse. In fact, in 2007, Beau Biden had established the state Child Predator Unit in the Attorney General's Office with investigators who focused on spotting incidents of child predation over the internet. The unit also investigates and prosecutes other crimes against children.
Before his resignation, Simmons was assigned as a deputy attorney general to the New Castle County Misdemeanor Trial Unit.
