Former syracuse lawyer Thomas Smith sentenced for child sex abuse
Thomas G Smith, 48, a lawyer formerly employed by the federal court in Syracuse was sentenced on Tuesday to six years probation for sexually abusing a 10-year-old boy. Smith had pleaded guilty to a misdemeanor and second-degree sexual abuse on October 16. He admitted to engaging in sexual contact with the boy in May and June. As a result of the conviction, the court declared Smith as a Level 1 sex offender.

Smith used to be a staff attorney assigned for handling prisoner matters before federal judges in Syracuse. While he is no more employed by the court, he is also facing an appellate court review of his license to practice law. That may be affected by his misdemeanor conviction and sentence.

While Assistant District Attorney Jeremy Cali submitted before Lysander town Judge Charles Mantione the crimes committed by Smith who had engaged in repeated sexual contact with the 10-year-old boy, records show that the plea deal was worked out between the attorneys even before charges were filed against Smith.

Cali submitted that at the time when the allegations against Smith were first reported to the Sheriff's Department's Abused Persons Unit, the prosecution had worked out a plea deal with Smith's lawyer. This was done even before investigation was still pending. However, Cali submitted that the victim's family was satisfied with the resolution.

During the sentencing, the mother of the victim, however, berated Smith by telling how her family and that of Smith's had been friends for years and how Smith had betrayed that trust by abusing her son.

Smith would be required to register as a Level 1 sex offender, and there would be no jail time.
