Nodine resigned after the Mother's Day shooting when his county issued truck was seen fleeing the scene. Nodine's wife filed for divorce the same day he was arrested in separate charges for possession of a controlled substance. Days later, he turned himself into Baldwin County, Ala. authorities after the warrant was issued for his arrest on the murder charges. While he was in jail waiting for bond to be raised, he was then hit with an indictment on federal gun charges. His resignation eliminated impeachment proceedings that would have taken place. It wasn't until several weeks following his arrest that several of his friends stepped forward to ante up the $500,000 bond.
In December 2009, sheriff deputies found marijuana in Nodine's county issued vehicle. An investigation was launched with the Alabama Bureau of Investigations. This followed a 2008 incident that included his loss of that county vehicle for six days during Mardi Gras in New Orleans. These investigations were already in process when Downs was killed.
Police were called to the home of Angel Downs in the early evening hours on Mother's Day after reports of shots being fired and witnesses said they saw Nodine's red Mobile County Ford pick up truck leaving the scene. Nodine checked himself into a local hospital later that same evening and left voluntarily the next day.
Testimony is expected to continue into next week before it goes to the jury.
