On November 21, the West Virginia Supreme Court sided with Massey Energy and "overturned [the] $76 million judgment," says a
press release. The court "set aside a 2002 ruling by the Circuit Court in Boone County that awarded $50 million to Harman Mining...and its president."
Of the latest ruling, Massey Chairman and CEO Don Blankenship said, "We are very pleased. We have always believed that the verdict in the lower court was wrong, and we have fought hard to get a fair result for Massey Energy's members and shareholders."
Massey Energy did have to pay $6 million to Harman in 2001 due to the original lawsuit; however, the case, the Supreme Court agreed, should have ended there.
