The battle began when the dog's owner, Ronald Callan Jr., shot himself on New Year's Day and left behind no will, a $2 million estate, and his dog, Alex. Surprisingly, the dog has received the most attention.

"Obviously, this is a very unusual set of circumstances," said Alex's attorney, Paul Royal, to the court. "At first glance, the petition seems almost frivolous, but after speaking with all parties, it is evident that this is a highly emotional issue for all involved."

All involved include Callan Jr.'s father, mother, former girlfriend, and fiancée, who was with Callan Jr. when he died.

Royal said to the court that he believes all four people love Alex and would take good care of him. But he said the parties are using the fight for the dog as a means of punishing each other for past transgressions.

"This case is similar to a bitter custody battle involving children where each party loves the children, but the kids are stuck between two people who cannot coexist," said Royal in his report.

After careful deliberation, a consent order was reached on Monday, May 7, 2007, which split custody between Callan Jr.'s parents. They each will get the dog for two weeks and will care for him accordingly, taking him to the veterinarian when necessary.
