Question:

I was laid off during the downturn, and have been working a non-legal job for a number of months while trying to find something new. Should I put it on my resume or not?

Should you mention a non-legal job on your attorney resume?

Answer:

Generally, no.

Attorneys often want law firms to know that they have been busy, and not sitting around watching TV, since their layoff. While this is good information for a firm to have, it can also hurt you to list non-legal jobs because it makes you looks desperate, and firms always steer clear of desperation.

While there is no shame in having to pay your student loans, it makes you look bad to law firms. No one wants to hire a person who got into trouble financially. People who are in trouble will take any job that comes along, and that is not desirable to law firms. They want someone who wants to stay with them a long time, not someone who wants a stop-gap to pay bills until they find something better. They want someone who is truly choosing them, not someone who is being forced to accept a position.

Non-legal jobs also suggest to firms that you are a bad planner. It suggests to them, whether or not it is true, that you didn’t see your layoff coming and now you have too few resources to fall back on. It suggests that you lived beyond your means. If firms assume that you can’t manage money, they will assume that you can’t manage your life or your practice. I should emphasize that this prejudice is completely unfair; not all of us are children of the 1% with money in the bank in case of emergency. But, the prejudice is very real, and this is why I do not recommend putting jobs that are non-legal on your resume.

Instead, in order to let firms know you have not been sitting around, list unpaid legal work you have done since your layoff. Did you close a real estate deal as a favor for a friend? Write a letter to a family member’s landlord? Did you volunteer your time at a pro bono organization? Participate in bar activities? List these things instead of a steady job that was not an attorney job.

If you must list a non-legal job, I recommend putting it at the very bottom of the resume under “Other Experience.” Always make a firm feel that you are choosing them because they are the best fit for you, and keep your financial woes to yourself.
