Kansas Lawyer Disbarred For Stealing; Braintree Lawyer Repeatedly Disbarred

On Friday, the Kansas Supreme Court disbarred an Overland Park lawyer, Michael Clay Schnittker for professional misconduct. The disbarment order mentions that Schnittker "systematically stole" more than $150,000 over a three-year period from his law firm.

According to court documents, Schnittker formed a partnership in 2003-2004 with Thomas H. Sullivan with the agreement to deposit all attorney fees earned into the operating account of the partnership. After payment of expenses, the balance funds were to be shared by the partners based upon the percentage of fees brought in by each.


From 2009 onwards, Schnittker began deposit part of attorney fees earned by him into his personal account rather than depositing them into the firm's operating account. He stopped the practice only after Sullivan, his partner, discovered the discrepancies from the financial records of the firm.

Experts hired for reviewing financial records of the firm found that Schnittker had taken more than $150,000 in earned attorney fees which should have been deposited into the firm's account.

Braintree lawyer repeatedly disbarred

Last week, there were reports about a Braintree lawyer, John C. McBride being repeatedly disbarred. First he was disbarred, and then he was disbarred again for practicing law while he was disbarred. While it might seem difficult to understand how one is disbarred when he is not in the bar in the first place, it seems the results are to extend and stack up disbarment running ad infinitum ad nauseum, if McBride practices law again.

However, with his disbarment now running up to 2021, and the man apparently lacking other skills of earning, it seems just a matter of time, before he tries to do what he knows - practicing law.

McBride was first reprimanded in 1993. He was disbarred in 2005, and he should have been eligible for reinstatement in eight years, which should have been this year. However, before his application for reinstatement and its approval could go through, McBride was hauled up for practicing law without a license, forgery and uttering.
