Paralegals Given Greater Authority to Sign Correspondence

However, substantive correspondence should be signed only by attorneys. Examples include documents for negotiating a settlement, drafting a contract, and interpreting the meaning or effect of legal documents.

Two New Jersey state Supreme Court committees feel that paralegals should be able to sign said routine correspondence if the attorney supervises the work and ''is aware of the exact nature of the correspondence, the paralegal's identity and non-attorney status is noted, and the name of the responsible attorney is set forth in the correspondence.''

This is a modification to ACPE Opinion 611, which states that ''paralegals may sign only routine correspondence that is not directed to clients, opposing lawyers or courts.''

Richard Steen, president of the State Bar Association, said the association has wanted Opinion 611 to be reconsidered for a long time. Per Steen, ''The opinion properly places the responsibility on attorneys, who are the licensed professionals ultimately answerable to the courts.''

Reasons cited for the change include paralegals' ever growing level of involvement in the legal profession, as well as difficulty in enforcing Opinion 611.

Paralegal Committee Chair Lynne DeRemigio said the issue merely needed clarification, and that, ''It appears the [paralegal] committee's concerns have been addressed.''

Several definitions of a paralegal exist. As defined by the American Bar Association, ''A legal assistant or paralegal is a person qualified by education, training or work experience who is employed or retained by a lawyer, law office, corporation, governmental agency or other entity who performs specifically delegated substantive legal work for which a lawyer is responsible.''
