Overview:
The Washington State Supreme Court recently ruled that the state's simple drug possession law was unconstitutional and void. As a result, thousands of convictions need to be vacated, including those of currently incarcerated individuals. The Office of Public Defense is seeking qualified attorneys to provide legal representation to indigent clients potentially eligible for relief under the Blake decision in Skamania County. This is a contract position for a period of time immediately through June 30, 2025.
Duties:
- Coordinate and communicate with criminal legal system stakeholders in the county
- Review data provided by the Office of Public Defense to prioritize relief for incarcerated individuals
- Provide representation for resentencing motions and motions to obtain a vacate and refund order
- Coordinate with other Blake contractors in the county
- Must have sufficient capacity to timely address any incarcerated client that needs resentencing relief
Qualifications:
Required:
- Licensed member in good standing with the Washington State Bar
- Carries malpractice insurance
- Class B violent adult felony-qualified under the WA Supreme Court Standards for Indigent Defense
- Knowledge of Washington State criminal law
- Experience with sentencing and offender scoring under the Washington's Sentencing Reform Act
Preferred:
- Class A felony-qualified
- Experience working with incarcerated people
- Experience practicing law as a public defense attorney
- Experience litigating CrR motions
- Experience working with marginalized communities
Compensation:
- hourly for contract attorneys
- hourly for paralegals or legal assistants providing support for contract attorneys' Blake work
- Hours available under the contract will vary month-to-month depending on local factors
- Contractors may be eligible for mileage and may bill the hourly rate for travel time
