Job Title: Agency Attorney 01
Job Responsibilities:
The Agency Attorney 01 position within the organization involves representing the organization in various legal capacities, primarily within the Housing Litigation's Landlord and Tenant Division. The attorney will engage in approximately 50,000 court appearances in Civil Court-Housing Part annually, handling cases related to non-payment, holdover, Section 8, lockout, repair, and commercial issues. The responsibilities include:
- Representing the organization in Civil Court-Housing Part, negotiating, drafting, and appearing before judges for stipulations of settlement in non-payment, holdover, and repair cases.
- Researching and preparing non-payment and holdover cases for trial, arguing them before a Housing Court Judge, and determining legal strategies, including the advisability of presenting witnesses and admissibility of evidence.
- Handling illegal lockout hearings, contempt cases, multiple petitioner cases, and commercial cases.
- Preparing legal documents such as briefs, motions, legal opinions, affidavits, memoranda, and other necessary legal papers.
- Representing and defending the organization in repair cases initiated by residents, negotiating stipulations of settlement, arguing motions, and potentially proceeding to trial; coordinating with Developments to facilitate repairs.
- Appearing in Bankruptcy Court as a Judgment Creditor to ensure the collection of pre-petition and post-petition rent.
- Maintaining confidentiality regarding all proceedings.
Education and Experience Information:
Minimum Qualifications:
- Admission to the New York State Bar.
- One year of satisfactory . legal experience after admission to any state bar or six months as an Agency Attorney Interne.
- Incumbents must remain members of the New York State Bar in good standing for the duration of employment.
For Assignment Level (AL) II:
- One year of experience at Assignment Level I or two years of comparable legal experience after bar admission related to the assignment.
For Assignment Level III:
- Two years of experience in Assignment Levels I and/or II or three years of comparable legal experience after bar admission related to the assignment.
Preferred Skills:
- Strong legal analysis, writing, and research skills.
- Strong interpersonal skills.
- Ability to clearly define and address factual and legal issues in writing and orally.
- Ability to work efficiently under pressure.
- Familiarity with housing laws and regulations, particularly public housing, Section 8, and other affordable housing.
- Familiarity with multifamily housing management, building systems maintenance, and construction law.
- Familiarity with privacy, confidentiality, and environmental law and regulations.
- Administrative law, policy, or legislative background or experience.
- Ability to devise creative solutions to accomplish agency objectives.
Salary Information:
The salary range for the Agency Attorney 01 position is $81, to $95, annually.
