Job Responsibilities
The Administration for Children’s Services (ACS) seeks a qualified Agency Attorney to join the Fair Hearings & Compliance Unit (FHCU) within the Office of the General Counsel. The selected candidate will primarily represent the Commissioner of ACS in administrative hearings and related Article 78 proceedings before New York State tribunals and courts concerning matters such as indicated reports of child neglect, adoption subsidy payments, kinship guardianship payments, foster care rates, and services. The attorney will engage in complex legal work, including:
- Maintaining a significant caseload of complex and/or sensitive cases
- Preparing and maintaining case files and documents in advance of court appearances
- Interviewing witnesses and other relevant parties, reviewing relevant agency and third-party records, and determining the strength and admissibility of evidence
- Liaising with other ACS programs, including adoption subsidy unit staff and executives, and with NYS OCFS representatives
- Reviewing and providing legal opinions and counsel to unit and other ACS program staff
- Drafting legal documents such as pleadings, motions, and memoranda following acceptable legal procedures
- Conducting and/or assisting with legal research, regularly reviewing relevant case law and regulations to support legal opinions

Education and Experience Information
Minimum Qualifications
1. Admission to the New York State Bar; and either:
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

For Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. For AL III, candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Preferred Skills
- Familiarity with Children’s Services’ policies and procedures, including relevant child welfare laws, social service laws, and the Family Court Act
- Familiarity with relevant NYS regulations and guidance
- Family law experience with strong research and writing skills
- Ability to track and meet multiple and varying deadlines

Salary Information
The selected candidate will be offered a salary between $87,003 and $100,053, with a salary range extending up to $128,440.

Section 424-A of the New York Social Services Law requires an authorized agency to inquire whether a candidate for employment with child-caring responsibilities has been the subject of a child abuse and maltreatment report.
