Job Responsibilities
The RCU Agency Attorney is a position within the **Members Only** under the General Counsel's Office. The primary responsibilities of the Agency Attorney include:
- Processing time-sensitive child protective services (CPS) record requests. This involves handling requests from various entities such as the Office of the District Attorneys across all five boroughs, federal subpoenas, interjurisdictional requests, legal advocacy groups, and individual requests from the public.
- Reviewing and assigning non-attorney staff work assignments and records requests, ensuring they are completed in compliance with applicable laws and in a timely manner.
- Providing instruction and legal support in the preparation and production of records.
- Offering litigation support to the NYC Law Department by producing ACS records, contracts, and other documents, along with witness notifications for the General Torts Division, Special Federal Litigation Unit, and the Special Litigation Unit.
- Assisting the Agency Privacy Officer (APO) in implementing the Identifying Information Law, which includes providing legal consultations, monitoring compliance with local laws, collecting data, and preparing quarterly and bi-annual reports for the Chief Privacy Officer, the Mayor, and the NYC Council.
- Responding to requests for child protective investigation records in accordance with New York Social Services Law.
- Managing Freedom of Information Law (FOIL) requests for agency records as per NY Public Officer’s Law.
- Drafting motions, legal memoranda, and appearing in court on subpoenas for agency records.
- Conducting legal research and drafting memoranda on confidentiality and privacy issues under NY Social Services Law, NY Public Officers Law, and the Identifying Information Law.
- Collaborating with the New York City Law Department on litigation matters related to state tort and federal special litigation cases.
- Assisting with special projects for the Records Management Unit, which handles the creation, distribution, and retention of records for the agency.
Education and Experience Information
Minimum Qualifications:
1. Admission to the New York State Bar.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar, or six months of satisfactory service as an Agency Attorney Interne.
3. Incumbents must remain Members of the New York State Bar in good standing throughout their employment.
For Assignment Level II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. For Assignment Level III, candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas related to the assignment.
Preferred Skills:
- One year of experience as an Agency Attorney Level 2.
- Excellent legal research and writing skills.
- Ability to exercise independent judgment.
- Strong interpersonal skills and capability to take direction from several supervisors.
- Familiarity with Children’s Services’ policies and procedures, including relevant child welfare laws and the Family Court Act.
Salary Information
The salary range for the RCU Agency Attorney position is $80, – $120,. The selected candidate will be offered a salary between $83,000 - $95,450.
