Job Responsibilities
The ELU Agency Attorney is responsible for handling a variety of legal tasks within the Employment Law Unit (ELU) of the **Members Only**. The main responsibilities include:
- Collecting and analyzing evidence of employee misconduct under Civil Service Law Section 75, which involves reviewing extensive child protective case records, time and leave records, incident reports, and criminal court documents.
- Assessing evidence of employee unfitness to perform job duties under Civil Service Law Section 72 and proceeding with appropriate actions.
- Drafting disciplinary charges, summaries of employees’ unfitness, and other necessary legal documents.
- Preparing cases for trial and presenting them at internal hearings and before administrative bodies, such as the NYC Office of Administrative Trials and Hearings (OATH).
- Participating in investigative interviews of witnesses and subjects.
- Determining the advisability of presenting witnesses, the admissibility of types of evidence, and matters of legal strategy.
- Recommending settlements and negotiating, drafting, and processing stipulations of settlement.
- Conducting legal research and preparing briefs, memoranda, and other documents.
- Investigating and responding to charges of discrimination filed with the United States Equal Employment Opportunity Commission, New York State Division of Human Rights, and New York City Commission on Human Rights by preparing position statements based on facts and applicable law.
- Attending arbitrations and acting as a liaison with the New York City Office of Labor Relations; serving as a liaison with the New York City Law Department on lawsuits involving employment discrimination and discipline, and liaising with other government agencies as needed.
- Collaborating with other ACS divisions and program areas, including but not limited to the Office of Human Resources, the Office of Equal Employment Opportunity, and the Office of Labor Relations, and assisting in providing training regarding employment law issues to ACS supervisors and managers.
- Fulfilling DOI information requests concerning employees under DOI investigation, in accordance with applicable legal requirements.
- Serving as a hearing officer in Step I and Step II grievance hearings in employee misconduct matters as needed and drafting decision memos on the same.
- Engaging in legal research and writing on new developments and agency policy regarding employment law.
- Training agency staff and leadership on relevant issues of employment law.

Education and Experience Information
Minimum Qualifications:

- Either one year of satisfactory United States legal experience subsequent to admission to any state bar or six months of satisfactory service as an Agency Attorney Interne (30086).
- Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III, candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Preferred Skills:
- Background in employment law and/or child welfare law.
- Trial advocacy.
- Legal research and writing.

Salary Information
The salary range for the ELU Agency Attorney position is $89, to $132,. The selected candidate will be offered a salary between $92,525 and $106,404.
