Job Title: Assistant District Attorney (Admitted Attorney - Appeals Bureau)
Job Responsibilities:
The Assistant District Attorney in the Appeals Bureau plays a critical role in handling the post-judgment litigation of the county's criminal cases. The primary duties include:
- Researching, writing, and arguing briefs in intermediate appellate courts and the New York State Court of Appeals, focusing on issues of criminal and constitutional law.
- Responding to collateral post-conviction motions seeking vacatur of convictions under Article 440 of the Criminal Procedure Law and conducting evidentiary hearings related to these motions.
- Answering petitions for writs of habeas corpus filed in federal court and briefing and arguing appeals arising from such cases in the . Court of Appeals for the Second Circuit.
- Counseling Assistant District Attorneys throughout the office on legal questions that arise at pre-trial, trial, and sentencing stages.
- Reviewing adverse decisions for potential appeals on behalf of the People, including researching, briefing, and arguing such appeals.
- Conducting conviction integrity reviews of post-conviction cases when warranted.
- Litigating specialized civil proceedings, including state habeas corpus and Article 78 petitions.
- Engaging in motion practice related to all stages of the appellate process.
Education and Experience Information:
Candidates for the Assistant District Attorney position must meet the following qualifications:
- Possess a Juris Doctorate (JD) degree from an ABA-accredited law school.
- Be a current member in good standing of the New York State Bar.
- Reside in New York State as of the effective date of employment with the organization.
- Have at least three years of experience practicing criminal law or conducting appellate work.
- Demonstrate a strong work ethic and attention to deadlines.
- Commit to a two-year employment period with the organization.
- Prior experience as an appellate attorney or equivalent work experience is strongly preferred.
Salary Information:
The salary for the Assistant District Attorney position is competitive and commensurate with experience, ranging from $85,000 to $163,000.
