Job Responsibilities
The Trademark Paralegal will be responsible for various tasks within the Intellectual Property team. These tasks include:
- Preparing documents for attorney review and filing with the United States Patent and Trademark Office (USPTO), which encompasses Applications, Office Action Responses, Declarations of Use and Incontestability, Applications for Renewal, and Extensions of Time to Oppose.
- Drafting appropriate identifications of goods and services and identifying suitable specimens.
- Ordering, conducting, and reviewing trademark searches, as well as preparing preliminary summaries.
- Monitoring watch notices to ensure timely action and compliance.
- Managing the execution and legalization of documents.
- Reviewing investigative summaries and preparing reports and recommendations for attorneys and clients.
- Corresponding with foreign associates regarding searches, filing and prosecuting applications, oppositions, registration maintenance, and transfers.
- Communicating with clients about trademark maintenance requirements to ensure compliance and avoid lapses.
- Assisting with trademark due diligence, preparing and recording assignments, and undertaking other chain of title activities related to corporate transactions.
- Monitoring deadlines and coordinating with the docketing team, although docketing is not directly required.
- Coordinating trademark opposition, cancellation, and other trademark disputes.
- Processing invoices from foreign associates and other vendors to ensure timely payment and accurate record-keeping.
Education and Experience Information
Candidates for the Trademark Paralegal position should meet the following educational and experience requirements:
- A Bachelor’s degree or a Paralegal Certificate is preferred.
- A minimum of five years of related experience in a law firm or law department is required, particularly in areas involving all aspects of USPTO trademark work, including prosecution, maintenance, and renewals, as well as Trademark Trial and Appeal Board (TTAB) proceedings such as oppositions and cancellations.
- The candidate must exhibit proactivity, dedication, positivity, and energy.
- Excellent written and oral communication skills are essential.
- Experience in handling large trademark portfolios is necessary.
- Strong computer skills are required, with proficiency in systems like SAEGIS, TO TEAS System, and Microsoft 365, including Outlook, Word, Excel, and Teams.
- Being resourceful and a creative self-starter is important for success in this role.
- The candidate must be able to balance competing active deadlines in a fast-paced environment.
- Superior organization skills are necessary.
- The ability to work independently and as part of a team is crucial.
- Strong interpersonal skills are required.
Additional desirable experience includes domain name experience and advertising review experience.
Salary Information
The national average salary range for the Trademark Paralegal role is between $58,000 and $110,000. The starting salary will be determined based on the candidate's location, qualifications, and experience.
