Job Title: Intellectual Property/Litigation Associate
Job Responsibilities:
- Manage a docket of cases involving the prosecution and defense of trademark, copyright, and trade dress infringement claims in both federal and state court, as well as before the USPTO and TTAB.
- Review and analyze evidentiary materials to develop case strategies from pre-suit investigations through pre-trial preparation and resolution.
- Draft legal pleadings including complaints, temporary restraining orders, and various motions such as summary judgment and post-judgment proceedings.
- Oversee the discovery process, which includes drafting and responding to written discovery requests and engaging in related motion practice.
- Participate in court conferences and take and defend depositions.
- Assist in developing written witness testimony and preparing witnesses.
- Draft mediation statements, trial-related motions, and jury instructions; participate in mediations, hearings, or trials as necessary.
- Draft cease and desist letters, settlement agreements, and related documents.
- Experience in administrative proceedings before the TTAB is beneficial.
- Participate in or supervise the civil seizure of counterfeit or infringing merchandise.
- Assist with trademark, copyright, and domain enforcement efforts, including online enforcement and administrative proceedings.
Education and Experience Information:
- A minimum of 3 years of relevant experience in intellectual property and litigation.
- Strong organizational skills and a high level of attention to detail.
- Excellent research, analytical, and writing skills.
- New York State Bar admission and admission to the SDNY and EDNY courts.
- Ability to travel if necessary.
