Senior Counsel - Global Commercial Operations

Job Responsibilities:
In this vital role, the Senior Counsel will be responsible for providing legal counsel to the company's Global Commercial Operations clients on a variety of legal and regulatory issues. These issues pertain to the promotion, sales, patient support programs, contracting, education, and scientific exchange regarding biopharmaceutical products that are regulated by several . Federal government entities. The primary responsibilities include:

- Advising and counseling on complex commercial transactions related to price concession strategies and risk mitigation, with a focus on the Anti-Kickback Statute and applicable antitrust laws.
- Analyzing, reviewing, and approving promotional, educational, and support programs and materials, and providing guidance on proposed sales and marketing strategies.
- Drafting and negotiating pricing agreements, supply agreements, and/or value-based agreements to strategically price company products.
- Reviewing and providing counsel on government enforcement actions concerning the promotion of biopharmaceutical products.
- Advising and providing ongoing training to key partners on legal, regulatory, and policy developments to ensure that legal support is adapted to a rapidly changing environment.
- Overseeing pricing agreement interpretation and contract enforcement, advising, and managing commercial dispute resolution.
- Supporting healthcare compliance related to the implementation of pricing agreements and/or sales and marketing activities.
- Coordinating legal support by contributing as a member of a cross-functional team and interacting with business and law department colleagues on various matters.

Education and Experience Information:
Basic Qualifications:
- . degree or . degree from an accredited law school.
- Admission to practice law in a . jurisdiction.
- Four (4) years of experience practicing law.

Preferred Qualifications:
- 6+ years of experience in corporate and/or law firm settings, counseling clients on healthcare/life sciences matters.
- Experience in counseling clients on complex legal and regulatory considerations, including healthcare fraud and abuse matters, FDA promotional regulations, OIG compliance guidance and advisory opinions, DOJ settlements with the pharmaceutical industry, and Medicare/Medicaid reimbursement and contracting.
- Proven superior legal skills, including excellent oral and written communication, legal analysis, drafting, and negotiation skills.
- Ability to lead and influence others.
- Strong client service, business counseling, and problem-solving focus.
- Ability to manage multi-dimensional projects in a fast-paced environment.
- Superior academic achievement.

Salary Information:
The expected annual salary range for this role in the . (excluding Puerto Rico) is between 230, USD and 280, USD. Actual salary will vary based on several factors, including relevant skills, experience, and qualifications.
