Job Title: Civil Attorney: Family - County Attorney
Job Responsibilities:
- Represent the Texas Department of Family and Protective Services (TDFPS) in Child Protective Services (CPS) legal cases within the organization, including courtroom representation in hearings and trials, mediation, and drafting of motions, briefs, and discovery.
- Provide counsel to TDFPS and other county offices on legal inquiries related to CPS and child welfare matters.
- Train TDFPS caseworkers and Child Protection Investigators (CPI) on investigations, Family Based Safety Services, conservatorships, and adoptions.
- Respond to community inquiries regarding family cases and refer to community resources when appropriate.
- Represent TDFPS in cases following a final order until children achieve permanency.
- Review and provide counsel on new cases, including intake documents such as petitions, orders of protection, and protective orders.
- Coordinate with investigators and legal assistants to compile evidence.
- Prepare for and represent TDFPS in contested hearings, including drafting legal briefs, interviewing witnesses, and making tactical decisions during trials.
- Participate in Family Recovery Court (FRC) staffings and hearings.
- Coordinate discovery requests, receipt, and responses.
- Communicate and collaborate with outside agencies, such as law enforcement, judges, and The Office of the Attorney General.
- Serve as a liaison between TDFPS, the Court, and the Department of Health and Human Services regarding Home and Community-Based Services for children with special needs.
- Staff current cases for progress, ensuring needs are connected to resources.
- Coordinate communication and actions in emergency situations.
- Assist the Mental Health Prosecutor with mental health cases/hearings as needed.
- Serve as “on-call” intake attorney in a rotation.
- Cross-train in civil division responsibilities.
- Collaborate with CASA of the organization and provide training to CASA volunteers and staff.
- Attend Multi-Disciplinary Team (MDT) meetings and provide insight to law enforcement and the Children’s Advocacy Center.
- Participate as a member of the community Fatality Review Team.
- Attend all required meetings and trainings.
- Perform special duties as assigned.
Education and Experience Information:
- Doctor of Jurisprudence from an accredited law school.
- Five (5) years of experience in a county or district attorney office, city attorney, or other governmental attorney with experience in related areas or six (6) years of family law experience as an attorney in relevant areas.
- Knowledge and understanding of the Texas Family Code and legal principles and theories.
- Working knowledge of Microsoft Office Suite, Adobe Acrobat, LexisNexis, and Westlaw.
Licenses and Certifications:
- State Bar of Texas.
- Valid driver’s license required within thirty (30) days of employment.
- Texas Crime Information Center (TCIC) certification and Criminal Justice Information Services (CJIS) certification required within six (6) months of employment.
Preferred Qualifications:
- Board Certification in Child Welfare or Family Law.
- Working knowledge of Odyssey and Digital Evidence Management System (DEMS).
- Bilingual (Spanish).
Salary Information:
$101, - $112, Annually
