Counsel - Global Commercial Operations
Job Responsibilities:
The Counsel for Global Commercial Operations will be responsible for advising the company's commercial value and access organization on a variety of legal and regulatory issues. Key responsibilities include:
- Advising and counseling on complex commercial transactions related to price concession strategies and risk mitigation, with a focus on the Anti-Kickback Statute and antitrust laws.
- Analyzing, reviewing, and approving promotional, educational, and support programs and materials; providing guidance on proposed sales and marketing strategies.
- Drafting and negotiating pricing agreements, supply agreements, and value-based agreements to strategically price products.
- Reviewing and counseling on government enforcement actions related to the promotion of biopharmaceutical products.
- Advising and providing ongoing training to key partners on legal, regulatory, and policy developments to ensure legal support adapts to a rapidly changing environment.
- Overseeing pricing agreement interpretation and contract enforcement, advising on and managing commercial dispute resolution.
- Supporting healthcare compliance matters related to pricing agreements and sales and marketing activities.
- Coordinating legal support by contributing as a member of a cross-functional team and interacting with business and department colleagues on various matters.
Education and Experience Information:
Basic Qualifications:
- . degree or . degree from an accredited law school.
- Admission to practice law in a . jurisdiction.
- Two (2) years of experience practicing Transactional and/or Commercial law.
Preferred Qualifications:
- 4+ years of corporate and/or law firm experience.
- Strong qualifications in transactional work in any industry, including structuring, advising, and counseling on complex transactions, and drafting, negotiating, and interpreting complex contracts.
- Experience counseling clients on complex legal and regulatory considerations.
- Proven superior legal skills including excellent oral and written communication, legal analysis, drafting, and negotiation skills, and sound judgment.
- Ability to lead and influence others.
- Strong client service, business counseling, and problem-solving focus.
- Ability to manage multi-dimensional projects in a fast-paced environment.
- Superior academic achievement.
- Experience in the healthcare industry is a plus but not required, including counseling on healthcare fraud and abuse matters, FDA promotional regulations, OIG compliance guidance and advisory opinions, DOJ settlements with the pharmaceutical industry, and Medicare/Medicaid reimbursement and contracting.
Salary Information:
The expected annual salary range for this role in the . (excluding Puerto Rico) is 188, USD - 230, USD. Actual salary will vary based on several factors including relevant skills, experience, and qualifications.
