Job Title: Administrative Hearings Attorney III

Job Responsibilities:
The Administrative Hearings Attorney III is responsible for representing the Department of Family and Protective Services (DFPS) before the State Office of Administrative Hearings (SOAH). The role involves handling cases related to due process hearings for findings of abuse and neglect of children. The attorney will oversee and plan legal activities, prepare legal documents, participate in hearings, interpret laws and regulations, and provide legal advice and counsel. The position requires working under limited supervision with considerable latitude for initiative and independent judgment. Key responsibilities include:

- Planning and organizing legal activities to ensure deadlines are met and successful outcomes are achieved for the agency.
- Coordinating the preparation of legal opinions, briefs, contracts, proposals, and reports.
- Researching legal concepts, case law, judicial opinions, statutes, and regulations relevant to DFPS.
- Coordinating and responding to open records requests and monitoring changes in state and federal court cases and rules.
- Coordinating and hearing administrative, regulatory, evidentiary, and enforcement hearings.
- Advising staff and the public on legal matters and the interpretation and application of agency regulations and state and federal laws.
- Enforcing agency regulatory provisions and prosecuting violations.
- Reviewing drafts of laws, rules, and regulations affecting agency operations.
- Scheduling hearings, interrogating witnesses, and preparing decisions on administrative appeals of decisions and rulings.
- Preparing cases for court trial and representing the agency in court matters as appropriate.
- Assisting in formulating, coordinating, and establishing policies and procedures.
- Assisting in preparing subpoenas for hearings and civil litigations.
- Drafting memoranda on regulatory matters and administrative rules for the Texas Register.
- Researching, drafting, or assisting in drafting bills and amendments for legislative consideration.
- Serving as a liaison with complainants to be represented in an administrative hearing or with their authorized representatives.
- Supervising the work of others as needed.

Knowledge, Skills, and Abilities (KSAs):
The position requires knowledge of legal principles, practices, proceedings, state and federal laws, rules, regulations, and agency administrative rules and regulations. Skills in legal research, writing, and analysis; computer and software use; reasoning and logic; problem-solving; workload prioritization; and judgment in identifying courses of action are essential. The ability to conduct hearings, prepare opinions and briefs, prepare cases for trial, conduct research, summarize findings, interpret and apply laws, use legal reference materials, communicate effectively, and supervise others is also required.

Education and Experience Information:
Applicants must be graduates from an accredited law school and licensed to practice law in Texas. They must be in good standing with the State Bar of Texas. The position is a full-time telework position, and candidates must pass a background check and, if applicable, a driver’s record check.

Salary Information:
The salary range for this position is $6, - $10,, classified under Salary Group TEXAS-B-26. The position is FLSA Exempt and offers eligibility for telework with up to 15% travel required.
