Job Responsibilities:
The Trademark Paralegal is responsible for a variety of tasks essential to the management and protection of trademarks. Key responsibilities include preparing filings for the United States Patent and Trademark Office (USPTO), which encompass Applications, Office Action Responses, Amendments to Allege Use, Declarations of Use and Incontestability, and Applications for Renewal. The paralegal supports attorneys in handling both domestic and international trademark opposition and cancellation proceedings. This involves preparing pleadings, managing document productions, filing documents with the Trademark Trial and Appeal Board, conducting Internet research, and assisting with enforcement actions such as drafting cease and desist letters.
The paralegal also communicates with clients regarding maintenance requirements for both US and foreign trademarks. This includes conducting online searches for trademark use and registration on a domestic and international level, analyzing search results to identify potential issues for attorneys, and assisting with trademark due diligence. The paralegal examines investigative summaries, prepares reports and recommendations, and coordinates with international associates to oversee the filing and prosecution of international applications. Additionally, the paralegal oversees the execution and legalization of documents.
Education and Experience Information:
- Bachelor’s degree with a strong academic record is required.
- A minimum of four (4) years of experience as a Trademark Paralegal in a law firm or corporation is required.
Required Qualifications:
- Ability to communicate effectively with clients and local counsel regarding issues that may arise during trademark prosecution, including evidence of use requirements and reclassifications.
- Proficiency in using trademark-related software and tools such as SAEGIS and the PTO TEAS System, as well as Microsoft Word, Excel, and Outlook.
- Highly motivated with a positive attitude and capable of working well within a team environment.
- Strong organizational skills with the ability to prioritize tasks, manage multiple responsibilities simultaneously, and meet deadlines efficiently.
- Competency in researching, analyzing, and synthesizing large volumes of data.
- Excellent attention to detail, including the ability to assess and respond to underlying detail issues and implications.
- Flexibility to work overtime as needed.
