Job Title:
Associate Counsel – No Fault
Job Responsibilities:
- Manage No-Fault claims, litigation, and arbitration, including inter-company arbitration for loss transfer and uninsured motorist claims.
- Respond to complaints, prepare motion documents, and draft discovery requests and responses, including writing legal memoranda.
- Review expert and medical reports, obtain subpoenaed records, and analyze both legal and factual issues.
- Attend court conferences, argue motions, and defend cases in arbitration.
- Oversee the activities of outside counsel to ensure quality and manage costs, while supporting No-Fault anti-fraud initiatives and the Special Investigation Unit, including administering Examinations Under Oath (EUO) for both claimants and providers.
- Provide managerial and supervisory oversight to the unit's paralegal team.
- Advise management and claims examiners on the applicability of No-Fault law and any changes that may occur.
- Research and implement special projects as requested by the General Counsel.
- Handle additional special projects assigned by Senior Management.
- Select, develop, and motivate personnel within the department. Provide career development for subordinates. Provide prompt and effective coaching and counseling. Responsible for the discipline/termination of employees when necessary. Review the performance of staff. Create a professional environment that respects individual differences and enables all employees to develop and contribute to their full potential.
- Other duties as assigned.
Knowledge, Skills, and Abilities:
- Experience in litigating No-Fault matters.
- Knowledge of Regulations 68 and 83.
- Basic knowledge of the No-Fault fee schedule and medical terminology.
- Excellent communication and interpersonal skills.
- Excellent organizational and presentation skills.
- Good interpersonal and analytical skills, including the ability to solve complex legal problems.
- Ability to work with all internal levels within a given organization, including the MTA Board.
- Ability to communicate and interact well with external agencies, which may include the Governor’s Office for New York State, New York City government, elected and other public officials, as well as any staff located at other federal or state agencies or authorities.
- Ability to work in a high-profile, high-pressure environment effectively.
- Ability to communicate effectively with key internal and/or external stakeholders.
- Strong managerial skills to effectively direct a staff of professional and technical employees in implementing the short- and long-term goals and direction for the area of responsibility.
- Ability to complete short- and long-term projects effectively and as efficiently as possible.
- Analytical capabilities and quantitative skills.
- Working knowledge of Windows, Lexis Nexis, Microsoft Office Suite or comparable applications, ., Word, Excel, PowerPoint, and Outlook.
Preferred Qualifications:
- Attainment of or in the process of attaining specific functional licenses or certifications in the area of specialty, if applicable.
- Familiarity with the company’s policies and procedures.
- Familiarity with the company’s collective bargaining procedures.
Education and Experience Information:

- License to practice law, maintained in good standing throughout employment.
- A minimum of three to five (3 to 5) years of experience in the field of No-Fault is desirable but not required for a highly motivated candidate who will receive specialized training required for the position.
Salary Information:
- Salary range: $134,734 - $154,500
Other Information:
- May need to work outside of normal work hours (., evenings and weekends).
- Travel may be required to other company locations or other external sites.
- According to the New York State Public Officers Law & the company Code of Ethics, all employees who hold a policymaking position must file an Annual Statement of Financial Disclosure (FDS) with the NYS Commission on Ethics and Lobbying in Government (the “Commission”).
