Job Responsibilities:
The role of the Intellectual Property Litigation Paralegal involves a variety of critical responsibilities aimed at supporting the law firm's clients and attorneys in intellectual property litigation matters. The paralegal is tasked with managing and maintaining client/matter files to ensure accuracy and completeness. They are responsible for analyzing and reporting on litigation metrics, which includes details about parties involved, courts, judges, as well as the outcomes of motions and litigation milestones.
Key duties include preparing discovery requests and responses, subpoenas, deposition notices, cover motions, declarations, proposed orders, exhibit appendices, and correspondence. The paralegal also assists with document collection processes and oversees document production to ensure compliance and efficiency. Another crucial responsibility is the electronic filing of documents in various courts, including federal and state courts in Texas, the Patent and Trademark Appeal Board, the International Trade Commission, and the . Court of Appeals for the Federal Circuit.
The paralegal performs factual and legal cite checking of motions and briefs using the Blue Book and other citation authorities, assembles shell drafts of patent disclosures, and assists with drafting and filing Inter Partes Review (IPR) and related papers. They prepare materials for court proceedings such as hearings, depositions, arbitrations, Markman hearings, and trials, and coordinate with external vendors to source competitive bids. Additional projects may be assigned as needed.
Education and Experience Information:
The position prefers candidates with a Bachelor’s Degree and a Paralegal Certificate from an ABA-accredited program. A minimum of six years of experience in a large law firm environment, preferably within an intellectual property litigation practice, is required. Candidates with commensurate work experience will also be considered. An understanding of the litigation life cycle and the timeline of patent disclosures is essential, along with familiarity with procedural rules such as the Texas Rules of Civil Procedure, related Local Rules, Federal Rules of Civil Procedure, USPTO Rules, and Patent Local Rules.
The role requires proficiency in Microsoft productivity tools, including Access, Excel, Outlook, PowerPoint, and Word, as well as proficiency with software such as document management software/iManage, TextMap, Relativity, Lex Machina, Docket Navigator, Westlaw, Lexis, USPTO research tools, ITC EDIS Online, PacerPro, Sanction, and Trial Director. The ability to proofread materials for contextual, grammatical, typographical, or spelling errors is also required.
Salary Information:
The salary range for this position in California is between and per hour. Actual compensation will be determined based on a combination of factors, including the candidate's experience and qualifications.
Work Condition and Environment:
The position is full-time and typically requires a five-day work week, with the possibility of overtime, including weekend hours, to meet deadlines or manage peaks in workload. The role may require occasional travel and is designed to be hybrid, with a minimum of three days per week (or at least 60%) in the office, and up to two days per week (40%) performed remotely. Physical demands include the ability to lift boxes of files weighing approximately 15 pounds and to lift and carry file folders weighing up to 5-10 pounds. The work environment is a typical interior/office setting, and the paralegal must be able to spend long periods working at a computer workstation.
