Tesla, a leading electric vehicle and clean energy company, is seeking an experienced litigation attorney to join their employment law team as the Sr. Counsel, Employment Litigation. This position will involve representing and defending Tesla in all aspects of employment-related litigation matters, making it a crucial role within the company's Legal Department.

As a member of Tesla's dynamic and fast-paced Legal Department, the Sr. Counsel, Employment Litigation will be responsible for handling primarily single plaintiff employment disputes and related litigation matters. This will include working closely with a paralegal to manage day-to-day aspects of employment litigation matters. The ideal candidate will have extensive experience with all aspects of employment litigation and arbitrations in California, including trial experience.

The Sr. Counsel, Employment Litigation will play a key role in defending Tesla in a variety of employment-related lawsuits and disputes, including those involving Title VII, FEHA, and other similar laws, affirmative action, disability access and accommodation, employee benefits, harassment and discrimination, unfair labor practice charges, wage and hour claims, wrongful terminations, and reductions in force. Some of the specific responsibilities for this role include:

- Conducting factual investigations and analyzing complex legal and factual issues
- Conducting extensive legal research and developing defense strategies for a wide range of lawsuits and disputes
- Responding to complaints and other pleadings, drafting and filing motions, and appearing in court
- Preparing witnesses for deposition and trial
- Negotiating for the dismissal or resolution of cases at all stages of the litigation process
- Responding to attorney demand letters and agency matters
- Staying up-to-date on current and emerging laws, regulations, and trends related to California employment and labor laws
- Leading in the management of outside counsel handling employment litigation

To qualify for this role, candidates should be licensed attorneys with at least 10 years of experience in California litigation, including state and federal court. They should also have previous experience in employment law and litigation, either at a law firm or government agency. Experience with defending PAGA actions and collective actions is a plus. Other qualifications for this role include:

- Extensive experience in employment defense litigation, including initial case assessment, strategy development, and handling various aspects of litigation such as discovery, motions, mediation, arbitration, and court trials
- A track record of efficiently working with a focus on client service in a fast-paced environment
- An entrepreneurial mindset with a willingness to take ownership of responsibilities
- The ability to work both independently and collaboratively, prioritize tasks, and thrive in a fast-paced and challenging environment
- A quick and flexible learner with strong analytical skills and the ability to make complex cost/benefit assessments
- Excellent communication skills, both oral and written
- A high level of integrity and ethics, and the ability to inspire trust and build relationships quickly with business partners

The expected compensation for this position is $172,000 - $431,640 per year, which may vary depending on factors such as market location, job-related knowledge, skills, and experience. The total compensation package for this position may also include other elements dependent on the role offered.
