Job Description:
- Highly responsible position in the Office of the General Counsel
- Enforce chapter 499, Florida Statutes
- Prevent fraud, adulteration, misbranding, or false advertising
- Safeguard public health and promote public welfare
- Administer Florida law in conformity with Federal Food, Drug, and Cosmetic Act and regulations
- Prosecute administrative cases targeting licensed and unlicensed entities
Responsibilities:
- Perform administrative prosecution for violations
- Analyze violations of statutes or administrative rules
- Recommend appropriate action
- Draft administrative complaints, letters of guidance, dismissal orders, settlement stipulations, consent orders, closing orders, and emergency action documents
- Present recommendations to probable cause panels or agency management
- Identify cases where emergency action may be appropriate
- Prosecute administrative complaints at the Division of Administrative Hearings or before the Department’s designated hearing officer or board
- Conduct other civil and administrative litigation on behalf of the Department
- Prepare pleadings, motions, memoranda, discovery, proposed orders, etc.
- Conduct legal research and participate in settlement negotiations
- Participate in meetings for non-board matters, probable cause panels, final agency action, board/division rule workshops
- Provide legal advice on Department matters
- Prosecute and defend final orders, emergency suspension orders, declaratory judgments, and rule waiver and variance decisions
- Respond to or review responses to public records requests
- Prepare correspondence applicable to particular cases or complaints
- Perform other duties as directed by supervisor or the Office of the General Counsel
- Assist other units as needed

Minimum Requirements:
- Bachelor of Laws or Juris Doctor from a law school accredited by the American Bar Association
