Job Title: Administrative Hearings Attorney III
Job Responsibilities:
The Administrative Hearings Attorney III is tasked with representing the Department of Family and Protective Services (DFPS) before the State Office of Administrative Hearings (SOAH). The role involves handling due process hearings related to findings of abuse and neglect of children, overseeing legal activities, preparing legal documents, participating in hearings, interpreting laws and regulations, and providing legal advice and counsel. Key responsibilities include:
- Managing legal workload to meet deadlines and ensure successful outcomes for the agency.
- Interacting with various stakeholders including caseworkers, program directors, agency attorneys, opposing counsel, judges, and community professionals.
- Preparing or supervising the preparation of legal documents such as opinions, briefs, contracts, reports, and memoranda.
- Researching legal concepts, case law, judicial opinions, and regulations relevant to DFPS.
- Coordinating and responding to open records requests and monitoring changes in state and federal court cases and rules.
- Preparing cases for court trial, scheduling SOAH hearings, interrogating witnesses, and preparing pleadings.
- Advising staff and the public on legal matters and the interpretation and application of agency regulations and laws.
- Providing legal training to agency staff and the legal community.
- Enforcing agency regulatory provisions and prosecuting violations to reduce liability.
- Reviewing drafts of laws, rules, and regulations affecting agency operations and providing consultation on legal risks.
- Scheduling hearings, interrogating witnesses, and preparing decisions on administrative appeals.
- Preparing cases for court trial and representing the agency in court as appropriate.
- Assisting in formulating, coordinating, and establishing policies and procedures.
- Assisting in preparing subpoenas for hearings and civil litigations.
- Drafting memoranda on regulatory matters and administrative rules for the Texas Register.
- Researching and drafting bills and amendments for legislative consideration.
- Serving as a liaison with complainants in administrative hearings.
- Supervising the work of others and performing related work as assigned.
Education and Experience Information:
- The candidate must have graduated from an accredited law school.
- Must be licensed to practice law in the State of Texas and in good standing with the State Bar of Texas.
Salary Information:
- Salary Range: $6, - $10, per month.
- The position is classified under Salary Group TEXAS-B-26 and is exempt under FLSA.
Additional Information:
- This is a full-time telework position with eligibility for telework.
- The position requires up to 15% travel.
