Job Title: Administrative Hearings Attorney III

Job Responsibilities:

- Represent the Department of Family and Protective Services (DFPS) before the State Office of Administrative Hearings (SOAH) in due process hearings related to findings of abuse and neglect of children.
- Oversee and plan legal activities, prepare legal documents, participate in hearings, interpret laws and regulations, and provide legal advice and counsel.
- Manage legal workload to ensure deadlines are met and successful outcomes for the agency.
- Interact routinely with caseworkers, supervisors, program directors, program administrators, agency attorneys, county and district attorneys, assistant attorney generals, opposing counsel, judges, agency clients, witnesses, community professionals, expert witnesses, protective services clients, and the general public regarding legal activities.
- Coordinate the preparation of legal opinions, briefs, contracts, proposals, and reports.
- Research legal concepts, case law, judicial opinions, statutes, and regulations on issues relevant to DFPS.
- Respond to open records requests and monitor changes in state and federal court cases and rules.
- Coordinate and hear administrative, regulatory, evidentiary, and enforcement hearings.
- Prepare cases for court trial, schedule SOAH hearings, interrogate witnesses, and prepare pleadings.
- Draft fair hearing orders for adoption assistance and permanency care assistance denials.
- Draft legal sufficiency reviews for investigation findings that are appealed.
- Advise staff and the public on legal matters and on the interpretation and application of agency regulations and state and federal laws.
- Provide expertise and instruction in family law, civil litigation, governmental, and other state and federal laws, regulations, and agency policy.
- Enforce agency regulatory provisions and prosecute violations to reduce liability of adverse impact on the agency.
- Review drafts of laws, rules, and regulations affecting agency operations.
- Schedule hearings, interrogate witnesses, and prepare decisions on administrative appeals.
- Prepare cases for court trial and represent the agency in court matters.
- Assist in formulating, coordinating, and establishing policies and procedures.
- Prepare subpoenas for witnesses, records, and documents for hearings and civil litigations.
- Draft memoranda on regulatory matters and administrative rules for the Texas Register.
- Research, draft, or assist in drafting bills and amendments for legislative consideration.
- Serve as a liaison with complainants in administrative hearings or with their authorized representatives.
- May supervise the work of others.
- Perform related work as assigned.

Education and Experience Information:

- Must have graduated from an accredited law school.
- Must be licensed to practice law in the State of Texas and in good standing with the State Bar of Texas.
- Knowledge of legal principles, practices, proceedings, state and federal laws, rules, regulations, and agency administrative rules and regulations.
- Skill in legal research, writing, and analysis; use of computer and applicable software; reasoning and logic; identifying and solving complex problems; prioritizing workloads; and using judgment to identify courses of action.
- Ability to conduct hearings, prepare opinions and briefs, prepare cases for trial, conduct research, summarize findings, interpret and apply laws, use legal reference materials, communicate effectively, and supervise the work of others.
- Ability to synthesize law, administrative rules, agency policies and goals, and best practice recommendations to reach an appropriate interpretation.

Salary Information:

- Salary Range: $6, - $10,

Additional Information:

- This is a full-time telework position.
- Must be eligible for telework and able to travel up to 15%.
