Job Title: Staff Counsel
Job Responsibilities:
The Staff Counsel will operate within the General Counsel Division, specifically in the Regulatory Enforcement and Affirmative Litigation Unit. This role involves a variety of legal tasks and responsibilities, including but not limited to:
- Supporting investigations into violations of licensing and consumer protection laws, specifically those related to the licensing and regulation of hotels and broker fees.
- Investigating and prosecuting businesses engaged in illegal conduct, ensuring compliance with New York City’s licensing and consumer protection laws.
- Identifying unlawful conduct for potential investigation and litigation, and developing investigation plans.
- Overseeing regulatory compliance projects for businesses.
- Developing large-scale regulatory enforcement plans to address and mitigate legal infractions.
- Conducting legal research and drafting memoranda on legal issues pertinent to the agency.
- Drafting general correspondence and legal documents for respondents, consumers, and other stakeholders.
- Conducting depositions and representing the agency in trials at New York City’s administrative tribunal.
- Drafting and negotiating settlement agreements in enforcement proceedings initiated by attorneys and field inspectors.
- Participating in agency outreach and training programs to educate businesses and the public.
The Staff Counsel will also handle special projects and assignments related to consumer or licensee issues or the operations of the Department of Consumer and Worker Protection (DCWP). This includes managing case projects and operational tasks necessary to support and implement the agency's work effectively.
Education and Experience Information:
Minimum Qualifications:
- Admission to the New York State Bar is required, along with either:
1. One year of satisfactory United States legal experience subsequent to admission to any state bar.
2. Six months of satisfactory service as an Agency Attorney Interne (30086).
- Candidates must maintain good standing as Members of the New York State Bar throughout their employment.
Additional Experience Requirements:
- For Assignment Level (AL) II: One year of experience at Assignment Level I or two years of comparable legal experience subsequent to bar admission in areas related to the assignment.
- For AL III: Two years of experience in Assignment Levels I and/or II, or three years of comparable legal experience subsequent to bar admission in related legal areas.
Preferred Skills:
- Experience in litigation, particularly in New York State courts and at the New York City Office of Administrative Trials and Hearings (OATH).
- Excellent verbal, written, interpersonal, analytical, problem-solving, and time management skills.
- Proficiency in conducting legal research and factual investigations, including reviewing documents and conducting witness interviews and depositions.
- Strong legal research, writing, and negotiation skills.
- Comfort with data-driven analysis and strategic planning.
- Attention to detail and ability to interact effectively with multi-functional teams of attorney and non-attorney staff.
- Ability to manage multiple priorities with competing deadlines.
- Experience and knowledge in consumer protection laws, administrative law, and/or false advertising litigation is preferred but not mandatory.
Salary Information:
The salary range for the Staff Counsel position is $83, to $124,.
Additional Information:
- This position may be eligible for remote work for up to two days per week under the Remote Work Pilot Program.
- New York City residency is not required for this position.
