Job Title: Special Counsel for Information Law - Ethics and Compliance

Job Responsibilities:
The Special Counsel for Information Law in the Ethics and Compliance Division of the organization is tasked with ensuring compliance with the New York State Freedom of Information Law (FOIL) and the New York City Identifying Information Law. The attorney will act as the agency’s Records Access Officer, responsible for receiving, tracking, and interpreting information requests made to the organization under FOIL. They will interact with staff across the department to locate, retrieve, and review documents that may be responsive to requests, and analyze the extent of information disclosure to requestors, issuing determinations to grant or deny requests. The Special Counsel will assist the organization’s Records Appeals Officer with FOIL appeal determinations and provide advice to the General Litigation Division on FOIL-related Article 78 defenses. Additionally, the attorney will advise and train City clients on FOIL law, practice, and legal updates.

As an "Agency Privacy Officer" under the Identifying Information Law, the Special Counsel will oversee day-to-day agency compliance by advising staff on privacy issues and approving projects/contracts involving identifying information. They will report quarterly to the City’s Chief Privacy Officer, draft the agency’s biennial report on information collections, disclosures, and retentions, and investigate privacy incidents within the department or by third-party contractors. The APO will also serve as a member of the Citywide Privacy Protection Committee, organized and managed by the City’s Office of Information Privacy.

The position includes participation in a pilot program allowing work from home on a limited and irregular basis or two set days per week, subject to division approval and operational needs. If in-person responsibilities arise on a scheduled work-from-home day, attendance is required.

Education and Experience Information:
Applicants must be graduates of an ABA-approved law school, admitted and in good standing with the New York State Bar, with at least one year of legal experience after law school. Experience with litigation and/or compliance with FOIL requests is preferred but not required. Candidates should possess excellent judgment, stellar organizational skills, strong research and legal analysis abilities, and be comfortable providing sound legal advice to senior-level attorneys.

Salary Information:
The salary range for this position is $84, – $175,.
