JOB SUMMARY:
The Associate Attorney will represent mortgage servicer and investor clients in a variety of legal matters, focusing on residential and commercial foreclosure, title, and general real estate litigation. This role involves handling consumer claims directly against the law firm's clients. Key responsibilities include making court appearances for both routine and contested hearings in state and federal courts, reviewing litigation cases and developing strategies, drafting legal documents, conducting discovery, and managing trials and evidentiary hearings. The role also encompasses handling state and federal appeals and engaging in settlement negotiations. The position offers flexibility in terms of work arrangements, allowing for in-office, hybrid, or fully remote setups depending on the qualifications of the successful candidate.
DUTIES & RESPONSIBILITIES:
- Manage a caseload of contested foreclosures, defensive litigation, and ancillary matters for mortgage servicers and investors.
- Prosecute commercial foreclosures from initiation to completion.
- Analyze loan files, title reports, and other client documents.
- Draft motions, pleadings, settlement agreements, and discovery demands and responses.
- Appear in court for settlements, case management conferences, motion arguments, trials, hearings, and appeals.
- Communicate with clients to ensure quality representation and compliance with client directives, including electronic communications through various online portals.
- Collaborate with support staff on the preparation and execution of documents for client signatures, court filings, and internal or client reporting.
- Research and analyze complex client cases, collaborating with partners for client advice and potential resolutions.
- Create matter budgets and seek fee approvals from clients in accordance with their requirements; track billable and non-billable time.
SUPERVISORY RESPONSIBILITIES:
This position may include supervisory responsibilities.
EDUCATION & WORK EXPERIENCE:
- . degree with a bar license in good standing in New York is required.
- Bar license in New Jersey, Pennsylvania, and/or Connecticut is not required but is considered a plus.
- A minimum of 5 years of relevant litigation experience is preferred, though less experience may be considered for otherwise qualified candidates.
- Working knowledge and experience with New York Mortgage Foreclosure Law and practice are required.
