Marketing, Advertising and Privacy Counsel
Job Responsibilities:
The Marketing, Advertising and Privacy Counsel reports to the Chief Compliance Officer and is a critical member of the Compliance department at the company. The role involves ensuring legal compliance across marketing and advertising initiatives. Among the primary responsibilities are:
- Marketing and Advertising Compliance Oversight: Ensuring that all marketing and advertising practices adhere to legal standards and guidelines.
- Regulatory Compliance & Risk Mitigation: Monitoring changes in relevant laws and regulations and implementing measures to mitigate compliance risks.
- Privacy & Data Protection Compliance: Advising on legal and compliance obligations related to data privacy and security.
- Advertising Review & Approval: Reviewing and approving promotional materials to ensure compliance with all relevant laws and regulations.
- Policy Development & Implementation: Developing and maintaining policies related to marketing, advertising, and privacy compliance.
- Monitoring and analyzing changes in marketing, advertising, and privacy laws to recommend proactive measures for compliance.
- Investigating and responding to regulatory inquiries or complaints related to marketing, advertising, or privacy practices.
- Ensuring compliance with all company policies and procedures.
- Maintaining regular and punctual attendance.
Other responsibilities include performing related duties as assigned and potentially providing guidance, leadership, or training to others, although this position does not have direct reports.
Education and Experience Information:
Candidates must have a Juris Doctor (.) degree from an accredited law school and an active state bar membership, preferably in NJ, PA, IN, FL, or NY. The role requires 10+ years of legal experience, with at least 5 years in mortgage lending, advertising law, privacy, and compliance within the financial services sector. Experience handling CFPB examinations, data privacy audits, and regulatory inquiries related to marketing compliance is preferred.
Qualifications:
- Strong knowledge of CFPB/FTC/state marketing regulations, TILA, RESPA, Fair Lending Laws, UDAAP, TCPA, and privacy laws such as GLBA and FCRA.
- Excellent analytical skills and attention to detail in regulatory risk assessment.
- Ability to train and collaborate with cross-functional teams, including sales, marketing, and compliance.
- Familiarity with HUD/FHA, VA, USDA, and GSE guidelines regarding borrower communications is preferred.
