Executive Agency Counsel, Non-Managerial (Level A & B)-Appeals is a competitive position within the General Counsel department at MTA, located in Brooklyn, NY. This position is responsible for handling a variety of tort claims brought against MTA and its agencies in state and federal trial and appellate courts. The successful candidate will have significant experience in all phases of tort litigation and appellate practice, as well as the ability to formulate legal strategies, protect the interests of MTA agencies, and reduce tort exposure.
Responsibilities:
- Handle complex, high-exposure appeals and other litigation matters related to personal injury claims against MTA agencies.
- Conduct legal research, draft appellate briefs, motions, and memoranda, and handle court appearances, including oral arguments and settlement conferences.
- Critically analyze personal injury claims and develop legal strategies to address novel legal issues, protect appellate rights, and reduce tort exposure.
- Accurately assess liability and damages exposures and make appropriate reserve and settlement recommendations.
- Provide legal advice and counsel on all phases of tort litigation and insurance coverage and indemnification matters.
- Effectively communicate and interact with external departments, such as operations and courts.
- Assist in achieving the business goals of the MTA Legal Department.
- Perform other duties as assigned by senior management.
Education and Experience:
- Level A: A law degree and admission to the Bar of the State of New York, with a minimum of four years of significant appellate litigation or other relevant experience.
- Level B: A law degree and admission to the Bar of the State of New York, with a minimum of five years of significant appellate litigation or other relevant experience.
- Extensive knowledge of local, state, and federal laws and regulations related to tort litigation.
Desired Skills:
- Proven ability to handle appellate matters independently and collaboratively as part of a litigation team under pressure and tight time constraints.
- Superior analytical, verbal, writing, and negotiation skills, with the ability to exercise sound judgment.
- Ability to build and maintain professional relationships with clients, adversaries, and the judiciary.
- Experience developing strategies to reduce tort exposure during all phases of litigation.
- Proficiency in forensic analysis of medical records and technical information.
- Command over various research methods, including legal research engines, internet searches, and investigative searches.
- Proficiency in Microsoft Office Suite or comparable applications, such as Word, Excel, PowerPoint, and Outlook.
Other Information:
- Employees in policy-making positions are required to file an Annual Statement of Financial Disclosure with the NYS Commission on Ethics and Lobbying in Government.
