Job Title: Special Counsel for Information Law - Ethics and Compliance

Job Responsibilities:
The Special Counsel for Information Law in the Ethics and Compliance Department is responsible for ensuring the Law Department's compliance with the New York State Freedom of Information Law (FOIL) and the New York City Identifying Information Law. The attorney acts as the agency’s Records Access Officer, receiving, tracking, and interpreting FOIL requests. This role involves interacting with staff across various divisions to locate, retrieve, and review documents responsive to these requests, analyzing the extent of information disclosure, and issuing determinations on whether to grant or deny requests. Additionally, the Special Counsel assists the Records Appeals Officer with FOIL appeal determinations and advises the General Litigation Division on FOIL-related Article 78 defenses. The role includes advising and training City clients on FOIL law, practice, and legal updates.

As an "Agency Privacy Officer" under the Identifying Information Law, the Special Counsel oversees day-to-day compliance across all department divisions, advises staff on privacy issues, approves projects/contracts involving identifying information, and reports quarterly to the City's Chief Privacy Officer. The role also involves drafting biennial Agency Reports on the collection, disclosure, and retention of identifying information and investigating privacy incidents within the Department or by third-party contractors. Moreover, the Special Counsel serves as a member of the Citywide Privacy Protection Committee, managed by the City's Office of Information Privacy.

Education and Experience Information:
Applicants must be graduates of an ABA-approved law school and admitted in good standing with the New York State Bar, with at least one year of legal experience post-law school. While experience with litigation and/or compliance with FOIL requests is preferred, it is not mandatory. The candidate should exhibit excellent judgment, organizational skills, strong research and legal analysis abilities, and be comfortable providing legal advice to senior-level attorneys.

Salary Information:
The salary range for this position is $84, – $175,.
