Job Title: Assistant United States Attorney (Civil)
Job Responsibilities:
Assistant United States Attorneys (AUSAs) in the Civil Division are responsible for handling two primary types of cases: affirmative civil enforcement (ACE) and civil defensive litigation.
1. Affirmative Civil Enforcement (ACE):
- Handle a variety of whistleblower actions and direct referrals from federal agencies like the Department of Health and Human Services (HHS), Food and Drug Administration (FDA), and Drug Enforcement Administration (DEA).
- Investigate potential health care fraud and other frauds, such as cases involving the medical necessity of health care services, payment of kickbacks for health care referrals, and fraud in managed care.
- Work closely with agents, medical experts, auditors, forensic accountants, and nurses to analyze complex factual and legal issues.
- Engage in formal and informal settlement negotiations, as most cases are resolved through settlement.
- Litigate cases in federal court, including written discovery, depositions, motions practice, hearings, and trials, if the government decides to file a complaint in intervention.
- Collaborate with attorneys in other . Attorney's Offices or attorneys in the Civil Frauds Section, Commercial Litigation Branch, Civil Division, DOJ.
2. Civil Defensive Litigation:
- Represent the interests of the United States, its agencies, and employees in a variety of civil defensive cases, including personal injury, premises liability, common law tort litigation, Bivens civil rights suits, statutory and constitutional challenges to government programs, Administrative Procedures Act actions, and employment discrimination cases.
- Analyze factual and legal issues, engage in written discovery, and work with fact and expert witnesses.
- Handle depositions, motions practice, mediation, and settlement conferences.
- Conduct dispositive hearings in federal and state courts and trials in federal court.
- Occasionally practice before the . Court of Appeals for the Eleventh Circuit.
Both ACE and Civil Defensive AUSAs will also be assigned immigration cases and various other litigation matters. Responsibilities will increase and assignments will become more complex as training and experience progress.
Education and Experience Information:
1. Education:
- Applicants must possess a Juris Doctor (.) degree.
2. Experience:
- Required: At least one year of . legal or other relevant experience.
- Preferred for ACE position: At least six years of . complex litigation and investigatory experience.
- Preferred for Civil Defensive position: At least two years of . litigation experience and the ability to handle a large caseload.
- Preferred qualifications include clerkship experience, strong academic credentials, and superior oral and written communication, legal research and writing, and interpersonal skills.
- Fair and sound judgment and the capacity to function in a highly demanding environment with minimal guidance are strongly preferred.
Salary Information:
- Assistant United States Attorney's pay is administratively determined based on the number of years of professional attorney experience.
- The range of basic pay is $120,086 to $195,100, including % locality pay.
Additional Information:
- This position requires . citizenship and residency in the district to which appointed or within 25 miles thereof.
- Applicants must be registered for Selective Service if applicable.
- Initial appointment is conditioned upon satisfactory preemployment adjudication, including fingerprint, credit, tax checks, and drug testing.
- Continued employment is subject to favorable adjudication of a background investigation.
- Relocation expenses will not be authorized.
- This position may require occasional travel.
- All initial attorney appointments are made on a 14-month (temporary) basis pending favorable adjudication of a background investigation.
