Job Title: Administrative Law Judge (ALJ)
Job Responsibilities:
The role of an Administrative Law Judge (ALJ) within the department involves a variety of responsibilities primarily focused on adjudicating tax-related disputes and appeals. Key duties include:
- Conducting hearings and rendering written determinations in response to petitions filed by taxpayers. These petitions typically protest notices issued by the NYC Department of Finance involving NYC business income and excise taxes, such as general corporation tax, unincorporated business tax, bank tax, commercial rent, and real property transfer tax.
- Acting as a presiding officer to hear and decide small claims tax cases, ensuring fair and impartial proceedings.
- Reviewing and determining annual applications for the correction of real property tax assessments on behalf of the **Members Only**.
- Conducting hearings and rendering written determinations on behalf of the NYC Office of Administrative Tax Appeals, ensuring compliance with applicable laws and regulations.
Education and Experience Information:
To qualify for the position of Administrative Law Judge, candidates must meet the following criteria:
- Admission to the New York State Bar.
- One year of satisfactory United States legal experience subsequent to admission to any state bar, or six months of satisfactory service as an Agency Attorney Interne (30086).
- Candidates must maintain their status as members in good standing of the New York State Bar for the duration of their employment.
For assignment to different levels within the role:
- Assignment Level (AL) II requires one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar in relevant areas of law.
- Assignment Level III requires two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar in relevant areas of law.
Residency Requirement:
- New York City residency is generally required within 90 days of appointment.
- City employees in certain titles who have worked for the City for two continuous years may be eligible to reside in surrounding counties such as Nassau, Suffolk, Putnam, Westchester, Rockland, or Orange County. Candidates should discuss residency requirements with the agency representative during the interview process.
Salary Information:
The salary range for the Administrative Law Judge position is $93, to $141,, reflecting the responsibilities and experience required for the role.
