Job Title: Assistant Attorney General I-III
Job Responsibilities:
The Assistant Attorney General I-III is responsible for representing the State’s interest in charitable trusts, deceptive trade practices, and other civil matters. This includes reviewing, evaluating, and rendering legal opinions, preparing cases for trial, and assisting in drafting bills for legislative consideration. The position involves working with the Consumer Protection Division to protect Texas consumers and the legitimate business community by investigating breaches of fiduciary duties, fraud, and deceptive advertising. The Assistant Attorney General will file civil lawsuits to enforce state and federal consumer protection and charitable trust laws, and educate Texans on recognizing and avoiding scams. The role requires managing cases from inception to resolution, including drafting memos, requests to examine, civil investigative demands, motions and pleadings, discovery, settlements, handling witness interviews, and appearing at hearings.
The Assistant Attorney General I will:
- Analyze complex factual and legal issues, develop evidence through various means such as witness interviews, undercover operations, and depositions.
- Represent the **Members Only** and other state agencies in court cases related to charitable trust and civil enforcement.
- Prepare legal documents including opinions, memoranda, briefs, pleadings, motions, and petitions.
- Participate in administrative and evidentiary hearings and the discovery process.
- Conduct legal research and report findings.
- Maintain up-to-date knowledge of the Deceptive Trade Practices Act and related statutes.
- Manage a low to medium volume of litigation cases and investigations.
- Maintain confidentiality and communicate with state agency representatives and consumers.
- Ensure compliance with agency policies and procedures.
The Assistant Attorney General II will perform all the above functions and additionally manage a medium to high volume of litigation cases and investigations.
The Assistant Attorney General III will perform all the above functions and additionally testify at hearings, trials, and legislative meetings.
Education and Experience Information:
Minimum Qualifications:
Assistant Attorney General I:
- Education: Must have graduated from an accredited law school with a Juris Doctor degree (.).
- Must be licensed as an attorney by the State Bar of Texas and be a member in good standing, eligible to practice law in Texas by the start date.
- Skills required include handling multiple tasks, prioritizing, meeting deadlines, legal research, writing, analysis, conducting investigations, mediation, negotiations, and effective communication.
- Ability to prepare legal documents, conduct research, interpret and apply laws, prepare cases and present at trial, and conduct hearings.
Assistant Attorney General II:
- Experience: Requires one year of full-time experience in fields such as corporation law, nonprofit law, charitable trusts, probate, estate, and trusts, consumer protection, commercial litigation, or civil litigation.
Assistant Attorney General III:
- Experience: Requires an additional year of full-time experience as a licensed attorney in the aforementioned fields.
Preferred Qualifications:
- Education with a focus on wills and estates, trusts, consumer protection, and/or commercial litigation subjects.
- Experience with electronic document review platforms and programs such as Excel, Microsoft Outlook, Adobe Acrobat, and Word.
- Knowledge of legal principles and practices related to the Texas Business Organizations Code, Texas Trust Code, nonprofit law, Texas Deceptive Trade Practices Act, and relevant consumer protection statutes.
- Proven abilities in leadership and working within a larger organization.
- Language proficiency in Spanish is advantageous.
Salary Information:
The salary for the Assistant Attorney General position ranges from $7, to $8, monthly, based on the Salary Admin Plan B, Grade 22, 24, 26. The position is exempt from overtime, and the work schedule is full-time with standard hours of per week.
