Job Title:
Senior Litigation Counsel

Job Responsibilities:
The Senior Litigation Counsel for the organization is responsible for assisting the Health Care Fraud & Abuse Section (HCFA) Section Chief with various duties and responsibilities, including managing a large section within the Criminal Division. The role involves overseeing criminal prosecutors tasked with investigating and prosecuting complex fraud-related felony cases. Key responsibilities include:

- Managing a caseload of complex fraud cases, coordinating with law enforcement agencies, and issuing grand jury subpoenas when necessary.
- Establishing litigation strategy, negotiating and drafting settlements, coordinating, analyzing, responding to, and/or initiating discovery efforts.
- Preparing and/or responding to and arguing all pretrial pleadings, handling all trial matters including witness preparation, examination, cross-examination, and argument.
- Preparing and responding to appellate matters as needed, including briefing and argument, and performing extensive legal research.
- Keeping the Section Chief Counsel informed of all actions that might require immediate attention.
- Establishing and maintaining inter-agency relationships with various law enforcement personnel throughout Arizona.
- Directing criminal investigations and prosecutions by mentoring Assistant Attorney Generals (AAGs) and managing their workload and performance.
- Assisting with interviews to hire employees within the HCFA Section.
- Advising and consulting with law enforcement on case development and strategies, reviewing police reports, bank records, interviews, and other relevant investigative material.
- Issuing grand jury subpoenas and reviewing the scope of requests, reviewing investigative affidavits and orders, and meeting with victims and/or witnesses.
- Evaluating the sufficiency of evidence to sustain criminal charges with a substantial likelihood of conviction.
- Determining criminal charges, identifying applicable statutory allegations and/or enhancers, composing evidence summaries for charges, and preparing exhibits.
- Drafting bond recommendations based on criminal history and applicable statutory factors.
- Reviewing grand jury procedures with law enforcement witnesses and preparing witnesses for testimony.
- Reviewing any material submitted by defense counsel for exculpation or mitigation, if submitted.
- Presenting criminal cases to grand jury for consideration and appearing for returns/Initial Appearances (IAs).
- Appearing in court on all criminal matters, including regular calendar, evidentiary hearings, and trials.
- Preparing motions/pleadings for filing in court, researching state/federal criminal and constitutional law, interpreting statutes and applicable law, conducting pretrial discovery, and interviewing witnesses.
- Conducting plea negotiations, preparing cases for trial, discussing trial strategies, and preparing sentencing memoranda.
- Preparing or responding to special actions, responding to post-conviction motions for restoration of rights, and petitions on entry of records.
- Conducting law enforcement trainings, participating in community outreach, representing the Attorney General's Office on advisory boards, and attending meetings and seminars as necessary and required.
- Performing other duties as assigned related to the position.

Education and Experience Information:
- A minimum of 10 years of legal experience is preferred.
- Admission to, and good standing with, the Arizona State Bar is required. Candidates must have an active Arizona State Bar license.
- Attorney applicants are required to submit a writing sample with their resume/application profile, which should contain an analysis of some substantive legal issue and provide insight concerning the candidate's ability to think, explain, and advocate for a particular position.
- Travel is required for this position, and a valid Arizona Driver’s License is required along with consent to have the driving record run periodically.
- All applicants under serious consideration for hire are required to be fingerprinted by the Office and complete a criminal background check through State and Federal agencies.

Salary Information:
The salary for the Senior Litigation Counsel position ranges from $71,500 to $100,000, with the position being classified under Grade 01. The position is open until filled.
