Position: Associate Senior Counsel, Privacy
Location: Multiple locations across United States (Bloomfield, Connecticut; Washington, District of Columbia; Chicago, Illinois; Boston, Massachusetts; St. Louis, Missouri; New York, New York; Philadelphia, Pennsylvania; Nashville, Tennessee)

Job Summary:

The Associate Senior Counsel, Privacy will provide legal advice and leadership for data loss incident preparation and incident response, as well as counsel related to advanced and cutting-edge data use and acquisition. This role requires expertise in HIPAA, state and federal privacy laws, data use regulations, and breach notification laws, along with strong communication skills and the ability to proactively identify and resolve issues. The position reports to the Chief Privacy Counsel and will collaborate closely with various departments within the company to ensure compliance with privacy and data protection laws.

Key Responsibilities:

- Provide legal advice and leadership for data loss incident preparation and incident response
- Counsel on advanced and cutting-edge data use and acquisition, as well as data mapping, classification, and related data management and governance
- Manage complex legal issues and risk related to data analytics, AI, de-identification, and use of nascent and emergent technologies
- Support the privacy, security, and data protection aspects of relationships and contracts with technology companies, “switch” vendors, HIEs, EMRs, app developers, and data aggregators
- Interpret and apply privacy and data protection law and contractual requirements to a wide variety of business initiatives
- Negotiate privacy and data use provisions in contracts
- Collaborate with other attorneys in the Legal Department as a subject matter expert
- Stay abreast of changes to privacy and data protection laws and regulations and communicate their impact on business operations
- Apply sound business judgment to the provision of legal advice and continuously look for opportunities to improve service

Qualifications:

- Juris Doctor degree
- 6-8 years of experience in healthcare regulatory compliance
- In-house privacy experience at a large, matrixed healthcare company preferred
- Deep understanding of HIPAA, state and federal privacy laws, data use regulations, and breach notification requirements
- Extensive experience assessing and mitigating legal risks associated with privacy and data governance, cybersecurity, data and digital transactions, and consumer experience
- Strong communication and negotiation skills
- Highly collaborative with the ability to influence others and build strong professional relationships
- Consistent sound judgment and strong analytical abilities
- Outstanding verbal and written communication skills
- Intellectual flexibility and ability to reassess priorities to fulfill expectations
- Strong ability to navigate through barriers to drive successful initiatives

Salary Information:

- Anticipated annual salary: $152,500 - $254,100 USD, depending on relevant factors such as experience and geographic location
- Eligible for annual bonus and long term incentive plan
