Job Title: Staff Attorney/Senior Staff Attorney

Job Responsibilities:
The primary responsibility of the Staff Attorney/Senior Staff Attorney is to conduct significant and high-visibility litigation on behalf of the organization or its affiliates. The attorney will provide legal advice concerning various legal issues such as pending legislation, regulatory matters, and activities opposing the organization’s mission to provide comprehensive reproductive health care. The role involves working closely with the Public Policy Litigation and Law (PPL&L) department, affiliate leadership, staff, coalition partners, and outside counsel. Specific duties include:

- Conducting litigation in state and federal courts across the country.
- Drafting trial court and appellate briefs and other legal filings.
- Conducting discovery, including document production and depositions.
- Preparing fact and expert witnesses for deposition and trial testimony.
- Presenting evidence and argument in state and federal court.
- Communicating with clients, co-counsel, and opposing counsel.
- Reviewing communications materials and responding to media inquiries.
- Engaging in work related to pending legislation and regulatory matters.
- Advising clients in navigating the rapidly shifting post-Roe legal environment.
- Coordinating with internal and external partners on litigation and related strategies.
- Supporting the career development of junior attorneys, interns, and paralegals.
- Contributing to the department’s ongoing work to center the communities most affected by laws restricting access to sexual and reproductive health and rights.
- Performing other duties as assigned.

Education and Experience Information:
Candidates must possess a law degree and have 4-9 years of legal practice experience. The title of Staff Attorney will be given to those with 4-6 years of experience, while those with 7-9 years of experience will be titled Senior Staff Attorney. Strong research and writing skills are required, and an established interest in public interest work, sexual and reproductive health and rights, and/or impact litigation is a plus, though not mandatory. Relevant skills and experience include:

- Trial court and/or appellate drafting and argument experience.
- Litigating Administrative Procedure Act claims.
- Litigating or advising on issues under the Medicaid Act or other federal funding programs.
- Experience working on trans rights issues and/or litigating cases to protect trans rights.
- Experience working in a coalition and/or with co-counsel for multiple organizational clients.
- Managing discovery, including document production and depositions.
- Working with fact and expert witnesses in preparation for deposition and trial testimony.
- Criminal defense and/or prosecutorial experience.
- Advising clients on compliance and risk mitigation issues.
- Reproductive justice work.
- Communications work in connection with litigation.
- Work on amicus briefs or strategy.
- Mentoring or supervising more junior attorneys or other colleagues.
- High proficiency in Google products.
- Flexibility and ability to adapt to quickly changing priorities and ambiguous situations.
- Commitment to the organization’s mission and diversity, equity, and inclusion, particularly surrounding race equity.
- A deep commitment to the organization’s mission of promoting sexual and reproductive health.

Salary Information:
The Public Policy Litigation & Law department has a pay scale for non-managerial attorneys based on years of legal experience. Staff Attorneys with 4-6 years of experience earn between $127,611 and $138,821, while Senior Staff Attorneys with 7-9 years of experience earn between $147,845 and $160,833. The total offer package includes generous vacation, sick leave, paid holidays, individual/family medical, dental, and vision benefits effective day one, life insurance, short/long term disability, paid family leave, and a 401k plan. Voluntary opt-in options for Flexible Spending Account (FSA) and Transportation/Commuter accounts are also available.
