Job Title: Public Defender
Job Responsibilities:
The Public Defender, specifically classified as Trial Attorney I, operates under close supervision and is tasked with defending clients involved in low-level misdemeanors, mental commitment hearings, and fugitive warrant cases in magistrate court. The role involves a range of responsibilities aimed at ensuring effective legal defense and protecting the legal rights of clients through all stages of legal proceedings. Key responsibilities include:
- Representing clients in low-level misdemeanor cases, mental commitment hearings, and fugitive warrant cases in magistrate court.
- Preparing and presenting legal arguments in appeals to the district court.
- Developing case strategies, investigating facts, and reviewing evidence to determine the best legal course of action.
- Drafting and filing necessary motions, briefs, and other legal documents, ensuring compliance with legal procedures and deadlines.
- Negotiating with prosecutors to secure favorable plea agreements or case dismissals when appropriate.
- Appearing in court to argue motions, represent clients at hearings, and conduct bench or jury trials.
- Collaborating with investigators, social workers, and expert witnesses to support the defense and address client needs holistically.
- Exercising independent judgment in managing caseloads and resolving legal issues with minimal supervision.
- Staying current on relevant laws, legal precedents, and procedural changes through continuing legal education and training.
- Conducting legal research and analyzing data and legal documents.
- Applying case law, the Rules of Criminal Procedure, the Rules of Evidence, and Constitutional principles.
- Reviewing and synthesizing discovery.
- Interviewing clients early and frequently, making decisions concerning bail, release from custody, and mental competency to stand trial.
- Determining the need for expert witnesses; locating appropriate experts and scheduling them for trial if needed.
- Working in the Case Management System (CMS) to document case work and timekeeping in accordance with SPD policy.
- Practicing vertical representation in all cases.
- Following the American Bar Association (ABA) standards for defending attorneys delivering indigent defense.
- Performing other duties as assigned.
Education and Experience:
Candidates for the position of Public Defender must meet the following educational and experience requirements:
- Possession of a Juris Doctorate (.) degree from an accredited college or university school of law.
- Licensed to practice law, with membership in good standing with the Idaho State Bar Association or the ability to obtain Idaho State Bar licensure within six months. Individuals hired before obtaining ISP licensure must pass the bar on their first attempt and/or obtain ISB licensure within six months. Failure to pass the bar will result in termination.
