Job Title: Regulatory Counsel
Job Responsibilities:
The Regulatory Counsel is responsible for providing legal and regulatory support, primarily focusing on supporting the Licensing & Data Privacy team within the company. Key responsibilities include:
- Monitoring legislative changes relevant to data privacy, cybersecurity, and Artificial Intelligence, ensuring that colleagues, management, and affected personnel are advised accordingly.
- Drafting responses to complaints filed with Departments of Insurance and/or other regulators by Property and Casualty and Accident and Sickness insureds.
- Responding to lawsuits, subpoenas, information requests, demands, and other litigation filed by insureds or third parties. This includes drafting responses, locating documents, liaising with claims, underwriting, or other internal departments, and creating litigation strategies.
- Advising on regulatory changes impacting the claims and broker department, including regulator guidance and data reporting requirements. Assisting stakeholders as needed to implement changes and/or submit work products to the relevant regulators.
- Keeping abreast of Canadian insurance licensing requirements to ensure compliance.
- Drafting reports for relevant internal Boards and Committees outlining legislative changes and proposals relevant to their assigned states.
- Advising on legal and regulatory issues in Canada, including company and employee licensing, claims handling, and broker agreements.
- Performing regulatory research and projects.
- Developing and implementing resource and training materials and programs.
- Researching and analyzing laws, regulations, and sub-regulatory materials.
- Providing written and verbal legal opinions on various legal issues.
- Drafting agreements, contracts, and other legal documents.
- Communicating and negotiating with external parties, such as regulators and external counsel.
- Managing outside legal counsel to ensure cost-effective and efficient legal services.
- Performing additional tasks as assigned by the manager.
Education and Experience Information:
- Juris Doctor and member of the bar in good standing in at least one state.
- Experience with Property and Casualty insurance and claims litigation is preferred.
- Knowledge of US data privacy, security, and Artificial Intelligence regulatory landscape, including CCPA, NYDFS Cybersecurity Amendments, GDPR, NIST standards, and HIPAA.
Skills and Abilities:
- Excellent oral and written communication skills, with the ability to clearly and concisely communicate regulatory requirements to stakeholders.
- Strong legal research skills, focusing on insurance regulatory research.
- Ability to determine, understand, and analyze legal/regulatory requirements and their impact on insurance contracts and business practices and plans, and develop solutions.
- Attention to detail, strong organizational skills, and ability to work on multiple tasks.
- Ability to interact and work collaboratively and constructively with various people at various levels within and outside the organization.
- Ability to appreciate the importance of, track, and meet deadlines.
- Professional, responsible, and responsive approach to role and functions.
- Strong computer skills, including a working knowledge of the MS Office Suite.
Salary Information:
The salary for this role will be tailored to the successful individual’s location and experience. The expected compensation range for this position is $138,000-$148,000 per year, plus a discretionary annual bonus.
