Job Responsibilities

The position of Trial Court Staff Attorney in the 20th Judicial Circuit involves a range of legal research and writing tasks aimed at assisting judges in various court matters. The primary responsibilities include:

1. Assist Criminal Division Judges
- Review and monitor post-conviction motions, conduct legal research, make recommendations to judges, and submit proposed orders.
- Review miscellaneous pre-trial or post-trial criminal motions and other criminal matters as requested, conduct legal research, make recommendations to judges, and submit proposed orders.
- Draft proposed jury instructions and advise on sentencing options upon request.
- Monitor death penalty proceedings, conduct legal research, make recommendations to judges, and submit proposed orders.
- Conduct research on current law and advise judges on various legal issues.

2. Assist Civil Division Judges
- Review and monitor petitions seeking extraordinary remedies, conduct legal research, make recommendations to judges, draft memoranda of law, and submit proposed orders.
- Review miscellaneous pre-trial or post-trial civil motions and other civil matters as requested, conduct legal research, make recommendations to judges, draft memoranda of law, and submit proposed orders.
- Conduct research on current law and advise judges on various legal issues.

3. Assist Appellate Banc with County-to-Circuit Appeals
- Review and monitor appeal files at pre-disposition stages, conduct legal research, make recommendations to the Appellate Banc, and submit proposed orders.
- Upon readiness for disposition, review trial records and appellate briefs, conduct legal research, submit memoranda with recommendations to the Appellate Banc, and submit proposed opinions.

4. Other duties as assigned by the Supervising Senior Staff Attorney and Judges.

Education and Experience Information

To qualify for the Trial Court Staff Attorney position, candidates must meet the following criteria:

- Juris Doctorate from an accredited law school.
- Proficient in computerized legal research, including Westlaw and/or Lexis-Nexis.
- Demonstrated work experience oriented towards public service.
- Ability to work occasionally outside normal business hours based on operational necessity.
- Proficient in Microsoft Word, Excel, and Outlook.
- Membership in good standing in the Florida Bar is required. If not already a member, membership is required within one year of hire.

Candidates must possess knowledge of legal principles, statutory and case law, court rules and procedures, and legal publications. They should be skilled in both manual and computerized legal research, legal writing, proof reading, and thorough editing. The ability to reason logically and analytically, comprehend and analyze complex legal issues, work well under pressure, and meet established timelines is essential.

Salary Information

The annual salary for the Trial Court Staff Attorney position is $63,. However, if the candidate has not yet passed the Florida Bar, the salary is 10% below the minimum. The position is eligible for a Competitive Area Differential (CAD) as approved by the Florida State Court System, up to $3, annually.

Additional Information

The Trial Court Staff Attorney position is considered a professional role within the Administrative Office of the Courts of the entire 20th Judicial Circuit, which includes Lee, Collier, and Charlotte Counties. Staff Attorneys may be required to travel within the circuit and may be temporarily or permanently reassigned to another county within the circuit based on operational necessity.
