Job Title: Public Defender (Trial Attorney III)

Job Responsibilities:
The Public Defender, specifically the Trial Attorney III, is responsible for defending clients in low-level felony criminal and delinquency cases, including but not limited to burglary and drug possession cases, child protective act cases, and felony specialty court proceedings. The attorney is expected to exercise a high degree of independent judgment in handling assigned cases and must develop case strategies, investigate facts, and review evidence to determine the best course of legal action. Key duties include:

- Representing clients in court, arguing motions, and conducting bench or jury trials as necessary.
- Drafting and filing necessary legal documents, such as motions and briefs, ensuring compliance with legal procedures and deadlines.
- Negotiating with prosecutors to secure favorable plea agreements or case dismissals when appropriate.
- Collaborating with investigators, social workers, and expert witnesses to support the defense and address client needs holistically.
- Providing guidance and mentorship to less experienced attorneys as needed.
- Staying current on relevant laws, legal precedents, and procedural changes through continuing legal education and training.
- Practicing vertical representation in all cases and following the American Bar Association (ABA) standards for defending attorneys delivering indigent defense.
- Managing caseloads and resolving legal issues with minimal supervision.
- Engaging in legal research and analyzing data and legal documents to apply case law, the Rules of Criminal Procedure, the Rules of Evidence, and Constitutional principles.
- Interviewing clients frequently and making decisions concerning bail, release from custody, and mental competency to stand trial.
- Determining the need for expert witnesses and scheduling them for trial if needed.
- Working in the Case Management System (CMS) to document case work and timekeeping in accordance with SPD policy.

Education and Experience Information:
The position requires a Juris Doctorate (.) from an accredited college or university school of law. Additionally, candidates must be licensed to practice law and hold membership in good standing with the Idaho State Bar Association. The position requires 1-2 years of experience as a practicing attorney or a 1–2-year judicial clerkship. Preferred qualifications include at least 3 years of experience practicing criminal law.

Salary Information:
The position offers an hourly pay rate with a minimum salary of per hour. The maximum salary is not specified.
