Job Title: Assistant Attorney General I-III
Job Responsibilities:
Assistant Attorney General (AAG) I:
- Analyze complex factual and legal issues, developing evidence through witness interviews, undercover operations, examinations under oath, depositions, requests to examine, civil investigative demands, and other discovery methods.
- Represent the **Members Only** and other state agencies in state and federal district and appellate courts in cases related to charitable trusts and civil enforcement pursuant to the Texas Business Organizations Code, Texas Trust Code, Deceptive Trade Practices Act, and other consumer protection laws related to privacy and technology.
- Prepare legal opinions, memoranda, briefs, pleadings, motions, petitions, and other legal documents.
- Participate in administrative and evidentiary hearings and the discovery process.
- Conduct legal research and report findings and conclusions.
- Maintain knowledge of the Deceptive Trade Practices Act and a variety of related statutes.
- Manage a low to medium volume of litigation cases and investigations, maintaining confidentiality and security of sensitive information.
- Communicate with representatives of state agencies and consumers.
- Perform related work as assigned and maintain relevant knowledge necessary for job functions.
- Attend work regularly and ensure compliance with agency policies and procedures, including those related to ethics and integrity.
Assistant Attorney General (AAG) II:
- All responsibilities of AAG I, plus managing a medium to high volume of litigation cases and investigations.
Assistant Attorney General (AAG) III:
- All responsibilities of AAG II, plus testifying at hearings, trials, and legislative meetings.
Education and Experience Information:
Minimum Qualifications:
Assistant Attorney General (AAG) I:
- Education: Graduation from an accredited law school with a Juris Doctor degree (.).
- Licensed as an attorney by the State Bar of Texas.
- Member in good standing with the State Bar of Texas and eligible to practice law in Texas by the start date.
- Skills in handling multiple tasks, prioritizing, meeting deadlines, legal research, writing, analysis, conducting investigations, mediation, negotiations, using reasoning and logic, identifying and solving complex problems, prioritizing workloads, judgment, and using a computer and applicable software.
- Skills in working under pressure and cooperatively with other attorneys, supervisors, investigators, and support staff.
- Effective oral and written communication skills.
- Ability to prepare legal documents, conduct research, interpret and apply laws, summarize findings, prepare cases and present at trial, conduct hearings, and communicate effectively.
- Ability to handle stressful situations, receive and respond positively to constructive feedback, work cooperatively with others in a professional office environment, provide excellent customer service, and work in person at an assigned OAG work location.
- Ability to arrange for personal transportation for business-related travel.
- Ability to work more than 40 hours as needed and in compliance with the FLSA.
- Ability to lift and relocate 30 lbs.
- Ability to travel (including overnight travel) up to 20%.
Assistant Attorney General (AAG) II:
- All qualifications of AAG I, plus one year of full-time experience in fields such as corporation law, nonprofit law, charitable trusts, probate, estate, and trusts, consumer protection, commercial litigation, or civil litigation.
Assistant Attorney General (AAG) III:
- All qualifications of AAG II, plus one additional year of full-time experience as a licensed attorney in related fields.
Preferred Qualifications:
- Education: Focus on wills and estates, trusts, consumer protection, and/or commercial litigation subjects.
- Experience: Using electronic document review platforms including Relativity and programs such as Excel, Microsoft Outlook, Adobe Acrobat, and Word.
- Experience: One year of full-time experience in fields such as corporation law, nonprofit law, charitable trusts, probate, estate, and trusts, consumer protection, commercial litigation, or civil litigation.
- Knowledge: Law and legal principles and practices relevant to the Texas Business Organizations Code, Texas Trust Code, nonprofit law, Texas Deceptive Trade Practices Act, and relevant consumer protection statutes, including state and federal privacy laws.
- Knowledge: Estate, probate, and trust laws and a wide variety of related statutes.
- Abilities: Proven ability to lead others and work within a larger organization.
- Other Language: Ability to proficiently read, write, and speak Spanish.
Salary Information:
- Salary (Pay Basis): $7, - $8, (Monthly)
