Assistant Counsel

Job Responsibilities
The Assistant Counsel will work within the Office of Professional Discipline (OPD) as part of the Office of the Professions under the **MEMBERS ONLY**SIGN UP NOW***. The primary responsibilities include:
• Participating in the development, supervision, and review of investigations into allegations of professional misconduct.
• Providing legal advice to OPD investigators and members of various State boards for the professions.
• Engaging in settlement negotiations in professional misconduct cases.
• Preparing for and trying cases before panels of the various state boards, including summary suspension hearings, moral character cases for individuals seeking licensure, and restoration of license cases for individuals whose licenses have been previously revoked or surrendered.
• Managing a significant caseload and assisting in training and guiding attorneys in the downstate offices of the OPD, especially in serious or complex misconduct cases and summary suspensions of professional licenses.
• Representing the OPD before the Regents Review Committee, researching and preparing well-written briefs, memoranda of law, specifications of professional misconduct, other legal pleadings, internal memoranda, and correspondence.
• Managing caseloads effectively and timely, and courteously interacting with members of the Board of Regents, various State professional boards, other State Education Department staff, opposing counsel, witnesses, and members of the public.
• Supervising staff attorneys in various OPD offices, including reviewing written work, assisting in case preparation, ensuring effective and timely management of caseloads, providing assistance during hearings, and assisting in ongoing training of OPD prosecutors as needed.
• Assisting, on occasion, and as directed by management, with networking with other New York State law enforcement and state agencies handling similar cases or work as OPD.

Education and Experience Information
Minimum Qualifications:
Candidates must be admitted to the New York State Bar and have six years of relevant, post-graduate experience, which includes significant trial work or administrative hearing experience demonstrating progressively responsible experience, as well as significant supervisory experience.

Preferred Qualifications:
Preference may be given to candidates who have familiarity with the licensed professions, significant trial work or administrative hearing involvement, and experience interpreting and drafting laws and regulations.

Salary Information
The salary range for the Assistant Counsel position is from $123,793 to $156,224 annually. Salary will be commensurate with education and experience.

Additional Information
These positions are in the exempt class, and the incumbent will serve at the discretion of the Commissioner of Education. Occasional same-day or overnight statewide travel will be required (10%). The position allows for the opportunity to telecommute up to 30% each bi-weekly pay period, granted at the discretion of the supervisor and the appointing office. Filling of this position is contingent upon Division of the Budget approval.
