Job Description:
As a member of our Intellectual Property Practice Group, the Patent Litigation Associate will work closely with clients to navigate complex patent laws and provide solutions for protecting their intellectual property. The ideal candidate will be a self-starter with excellent communication and judgment skills, a strong commitment to excellence, and the ability to thrive in a fast-paced environment. Salary Information:
The anticipated annual salary ranges for this position, depending on location, are as follows:
- Chicago, IL: $275,000-$350,000
- Los Angeles, CA: $275,000-$350,000
- San Francisco, CA: $275,000-$350,000
- Washington, DC: $275,000-$350,000
- New York City, NY: $275,000-$350,000
In addition to a standard benefits package, this role may be eligible for additional contingent compensation based on factors such as work performance, geographic location, experience, education, and qualifications. These salary ranges are Nixon Peabody's good faith estimate of the annual salaries for this position at the time of posting, as the contingent compensation is not yet calculable or may be zero in some circumstances.
Job Requirements:
The ideal candidate for this position will have at least 4-8 years of patent litigation experience, including drafting and responding to pleadings, preparing infringement and invalidity claim charts, Markman and claim construction proceedings, fact and expert discovery, inter partes reviews, and overall litigation strategy. USPTO admission and an undergraduate degree in Electrical Engineering or Computer Science, or substantial experience in these areas, are highly desired.
Key Responsibilities:
- Drafting pleadings, motions, memoranda, and correspondence for state and federal court, arbitration, and mediation proceedings
- Responding to complex discovery requests
- Communicating and negotiating with opposing counsel
- Preparing for and conducting depositions
- Preparing for trial, including exhibit lists, evidentiary objections, motions in limine, and witness preparation and examination
- Drafting Federal Circuit appeal briefs
- Supervising and training junior associates
Qualifications:
- 4-8 years of patent litigation experience
- Strong academic credentials
- Excellent judgment and communication skills
- USPTO admission (preferred)
- Undergraduate degree in Electrical Engineering or Computer Science (preferred)
