Job Title: Senior Counsel, Privacy
Job Responsibilities:
- Counsel on legal compliance related to the collection and use of personal information, covering consumers, employees, and applicants. Ensure adherence to laws such as CCPA, COPPA, TCPA, CAN-SPAM, CASL, PIPEDA, MoCRA, GDPR, and state privacy laws related to AI, health, youth, cybersecurity, and social media.
- Provide guidance on generative AI initiatives and participate in the Responsible AI Committee. Advise leadership on AI law developments that may pose risks to the business.
- Develop program updates, expansion, and remediation; assist in managing company compliance with relevant privacy and data protection laws, including implementing new requirements.
- Manage regulatory responses to inquiries from regulators as they arise.
- Foster a culture of privacy and drive privacy awareness and education.
- Work with internal clients and legal colleagues to negotiate data processing agreements and other privacy-related agreements. Contribute to the improvement of standard forms of agreements, alternate language playbooks, and internal resource documents about privacy and data processing matters.
- Lead data privacy incident response in partnership with the Cybersecurity team; manage, triage, and document all data incidents as they arise. Notify regulators and global teams as required.
- Manage and support privacy-related litigation and legal disputes.
- Manage a team of three privacy professionals and the enterprise data privacy compliance program.
- Act as a contact for privacy issues involving the company Canada business while working with local counsel in those jurisdictions.
- Partner with company Global on privacy projects as they arise and assist in providing KPIs to the Global Privacy team.
- Attend retail industry group privacy meetings, track state, provincial, and federal privacy legislation, and advise leadership and business teams on potential impacts.
Education and Experience Information:
- Over 8 years of experience in privacy law, preferably with experience in the retail industry.
- Strong academic credentials and training at a major national law firm; in-house experience is a plus.
- California Bar Membership is required.
- Experience in a dynamic and fast-paced environment, with the ability to effectively prioritize multiple projects simultaneously under time-sensitive deadlines and adapt quickly to changing priorities.
- Strong project management skills with an emphasis on being detail-oriented and organized.
- Ability to work independently as well as collaboratively with cross-functional teams.
- Enthusiasm for taking on new and additional responsibilities as business and team needs evolve.
- Passion for continuous learning and professional development, with flexibility and willingness to dive into any projects requiring support.
Education Certification and Licenses:
- California Bar Membership
- CIPP preferred
Salary Information:
The annual base salary range for this position is $216, - $242,. The actual base salary offered depends on various factors, including the applicant’s qualifications for the position, years of relevant experience, specific and unique skills, level of education attained, certifications or other professional licenses held, other legitimate, non-discriminatory business factors specific to the position, and the geographic location from which they will perform the job. Individuals employed in this position may also be eligible to earn bonuses.
