Job Title: Attorney 3, Appeals
Job Responsibilities:
The Attorney 3 within the Appeals & Protests Unit is responsible for providing legal advice and representation for the organization in contested tax matters and appeal-able agency actions before the Office of Administrative Hearings. Key duties include:
- Preparing and reviewing protested cases for formal hearings, including pre-hearing case memoranda, witness preparation, and exhibit preparation.
- Representing the organization before the Office of Administrative Hearings and in appeals to the organization's Director.
- Writing accurate, appropriate responses to technical taxation questions for the department, other government agencies, and the public, and educating taxpayers on complying with tax laws.
- Completing special projects as assigned, including researching legal issues for advising on policy-making purposes.
- Staying current on laws, regulations, policies, and best practices related to taxation through self-directed research, professional engagement, and continuous education.
- Participating in team and individual effectiveness activities, such as staff meetings, training, and work teams.
- Acting as a liaison to the Attorney General's Office when necessary.
- Performing other duties as assigned.
Education and Experience Information:
- A relevant degree from an accredited college or university, such as a Doctor of Jurisprudence degree (.).
- A valid license to practice law in the State of Arizona.
- Experience with Transaction Privilege Tax is considered a plus.
Knowledge, Skills & Abilities (KSAs):
- Understanding of Arizona Revised Statutes Title 42, administrative rules, Model City Tax Code, tax ruling, tax procedures, and departmental policies.
- Familiarity with contested hearings, appeals, federal case law, and general principles of law related to tax issues.
- Strong verbal, written, and listening communication skills.
- Proficiency in English, business, legal, and professional writing.
- Effective organization and time management skills, with the ability to manage multiple projects and work under pressure.
- Strong interpersonal skills and proficiency in using a PC in a Windows environment and MS Office and Google Suite applications.
- Ability to clear a comprehensive background and clearance process, including Arizona tax compliance verification and a criminal background check.
- Ability to apply case law, statutes, and administrative rules to facts, conduct legal research, and prepare legal briefs and memoranda.
- Ability to present and argue cases before hearings, conduct legal research, and apply statutes and case law to appeal cases.
- Ability to work autonomously and collaboratively, maintain confidentiality, and solve problems using advanced analytical skills.

Salary Information:
- $71,500 per year ( per hour).
Additional Job Demands:
- Must be able to exert up to 20 pounds of force occasionally and up to 10 pounds frequently.
- No substantial exposure to adverse environmental conditions.
Pre-Employment Requirements:
- Employment verification and reference checks.

- Arizona tax filing records check.
- If applicable, an ASEDRA Authorized Driver Identification Check.
